RESOLUTION NO. 75-62
A RESOLUTION GRANTING APPROVAL OF CONDI-
TIONAL USE AS LISTED IN ORDINANCE
NO. 6871, ARTICLE V, SECTION 1(6) (b) FOR A
CHANGE OF USE OF LOTS 9, 10, 11, AND 12,
ORCHID DELL GARDENS (7-143), AT APPROXI-
MATELY 1570 NORTHWEST TWENTY-SIXTH AVENUE,
AS GRANTED BY CITY COMMISSION RESOLUTION
NO. 72 --415 , DATED JULY 20, 1972, TO PERMIT
OFF-STREET PARKING LOT ON ABOVE SITE,
WITH ONE 10-FOOT OPENING FOR INGRESS ONLY,
SUBJECT TO: (1) THE APPLICANT PLACING A
DEVICE WHICH WILL PERMIT INGRESS BUT WILL
NOT PERMIT EGRESS; (2) A HEAVY BAR PLACED
AT SUCH A HEIGHT ABOVE THE OPENING THAT
IT WILL PERMIT THE ENTRY OF PASSENGER
VEHICLES BUT WILL NOT PERMIT THE ENTRY
OF TRUCKS; ALL IN CONJUNCTION WITH RETAIL
STORE COMPLEX AT 1575 NORTHWEST TWENTY-
SEVENTH AVENUE FOR A PERIOD OF TWO YEARS;
ZONED R-2 (TWO FAMILY).
WHEREAS, the Miami Zoning Board, at its meeting of
September 23, 1974, Item #5, following an advertised hearing,
adopted Resolution No. ZB 147-74 by a five to one vote (one
member abstained) denying any changes of use of Lots 9, 10, 11,
and 12, Orchid Dell Gardens (7-143), at approximately 1570
Northwest Twenty-sixth Avenue; and
WHEREAS, notwithstanding the recommendation of the
Zoning Board, the City Commission finds it advisable and in the
best interest of the inhabitants of the City of Miami to approve
the change of use of Lots 9, 10, 11, and 12, Orchid Dell Gardens
(7-143), at approximately 1570 Northwest Twenty-sixth„A-v nu

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA;

Section 1. The request for Change of use of Lots 9,
10, 11, and 12, Orchid Dell Gardens (7-143), at approximately
1570 Northwest Twenty= -sixth Avenue, as granted by the City
Commission, Resolution No. 72-415, dated July 20, 1972, to permit
off-street parking lot on above site, with one 10-foot opening for
ingress only, subject to: (1) the applicant placing a device which
will permit ingress but will not permit egress;
(2) a heavy bar
placed at such a height above the opening that it will permit
the entry of passenger vehicles but will not permit the entry
of trucks; all in conjunction with retail store complex at
1575 Northwest Twenty-seventh Avenue for a period of two years;
zoned R-2 (two family) be and the same is hereby granted.
PASSED AND ADOPTED this 9 day of JANUARY ,
1975.

HISTORY: On January 9, 1975 the City Commission ctranted
a Chance of Use of site as orininally granted
by Resolution 72-415 to permit a paring lot
with one 10' opening subject to following con-
ditions and review in two year:;:
1. Applicant placi nc, a device to permit ingress
with no egress.
2, A heavy bar p1 aced at such a height ahove the
openincl to permit cars but no trucks.
INSPECTION:
RECOMMENDATIONS:
PLANNING DEPT.
The Building Department reports _'iat neither of
two devices is heini used and that they have
notified the owner to replace Chem.
The original conditions attached to the granting
of this use should he reinstated and en Forred .
These conditions were instituted by which to
assure minimum commercial impact upon the abutting
residential neighborhood.

Resolution No. 75-(.2
On January 9, 1975 the City Commission granted approval of a Condi-
tional Use for a change of use of the above site as granted by
City Commission Resolution No. 72-415, dated July 20, 1972, to permit
off-street parking lot on above site with one 10' opening for ingress
only and subject to certain limitations; subject to yearly review.
The attached report from the Zoning Division of the Building Department
indicates that the intent of the Resolution is not being met.
It is suggested that this matter be placed on the City Commis: ion
agenda of January 19, 1978 for review.

The City Commission passed the above Resolution granting relief
from the requirements of the Comprehensive Zoning Ordinance, to
be automatically renewed each year for one year poi -lads, until
such time as the Commission shall rescind its waiver.
Would you please inspect the subect property to ni:tVe sure that
the intent of the Resolution is being met, and return this fom
to us, showing the results of the inspection below.
Recommend automatic renewal of Resolution.
