FLORIDA; AND ACCEPTING THE DEDICATIONS SHOWN ON
SAID PLAT; AND ACCEPTING THE COVENANT TO RUN WITH
THE LAND POSTPONING THE IMMEDIATE CONSTRUCTION OF

WHEREAS, The City Zoning Board and the Department of Public
Works have recommended the acceptance of the plat entitled COMET
SUBDIVISION;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Plat entitled COMET SUBDIVISION being a re -
subdivision of the west 60 feet of Lot 14, Block 6, of "WALDIN
ACRES" (Plat Book 5, at Page 68), lying in the N.W. 4 of the S.E.
of Section 33, Township 53 S, Range 41 E, City of Miami, Dade
is made a part hereof as if
County, Florida, which by reference
fully incorporated herein and the dedications as shown thereon to-
gether with all existing and future planting, trees and shrubbery
on said property, to the perpetual use of the public, be and the
same are, hereby accepted and confirmed by the C C y Curl

Section 2. The Covenant To Run With The Land executed by
Leonel Alonso and Miriam G. Alonso postponing the immediate con-
struction of sidewalk until such time as required by the Department
of Public Works of the City of Miami is hereby accepted and the
proper er officials are directed to record said covenant after Plat
has been recorded in the Public Records of Dade County, Florida,

ereitiafter referred to as "the owner" or "he", irrespective
Of adtual gender and number, and meanings either singular or
plural and including heirs, assigns and successors in interest
thereof, where the context so requires or admits) is the present
fee simple owner of a subdivision entitled COMET SUBDIVISION as
recorded in Plat Book . , at Page , of the Public Records
of Dade, County, Florida; and
WHEREAS, The City of ,Miami, a municipal corporation in
the State of Florida, in the County of Dade, (hereinafter
referred to as the "City"), pursuant to Chapter 54, Section
54-20 of THE CODE OF THE CITY OF IMIAMI, FLORIDA, requires the
OWNER to construct, or c :u:-. ; to he cone;tu?tecl at no expense to
the CITY, the following inp'oven;ont:s within the area and/or on
the streets abutting said subdivision sidewalk; and
WHEREAS, the OWNER asks to be relieved of his obligation

the CITY that he will at his ov:u expense construct the afore-
mentioned improvements at such time in the future as he is
notified by the CITY that the afornmentioned improvements are
necessary or desirable;
NOW, THEREFORE, in consideration of the agreements herein
set out, the OWNER hereby covenants and agrees with the CITY to.
construct or cause to be constructed at the expense of the OWNER,
and without cost to the CITY, the aforementioned improvements
within the area and/or on the street right of way abutting the
aforesaid subdivision, upon thirty (30) days written notice from
the Director of the Department of Public Works of the City of
Miami, Florida, addressed to the OWNER at 2535 S. W. 19 Street,
Miami, Florida 33133.
It is expressly agreed that this obligation shall be binding
upon the 01JNER, his heirs, successors in interest or assigns, and
shall be a condition implied in any conveyance or other instrument
affecting the title to the aforesaid subdivision or any portion
thereof.
In the event that the GWI;:_it or any future fee simple owner
of any lot in said subdivision shall fail to cause the afore-
mentioned improvements to be constructed within the area, and/or
in the street right of way abutting the property platted as herein
provided within thirty (30) days after the mailing of the written
notice from the Director of the Department of Public Works of The
City of Miami, Florida, then the City Manager of The City of Miami,
Florida, shall act as agent of the OWNER or any fee simple owner
of any lot or parcel described in said written notice, which agency
is hereby specifically created, and said City Manager shall cause
the aforementioned improvements to be constructed at the expense
of the OWNER and/or said fee simple owner, and the amount of such
construction cost shall be declared and established as a lien on
the property of such defaulting OWNER and enforced as any lied for
materials furnished and work and labor done, as provided under the
Statutes of Florida,

The proposed Record Plat entitled COMET SUBDIVISIONill consist a porfione lot

zoned R-2. This plat is being forwarded to your office for City Com-
mission action.
The attached detailed report from the Department ofopPublic
Worksof Miami,l'reco-
mends the approval of this plat by the City
and certifies its correctness as to form.
Also attached are the following itemized papers necessary to present
the Plat to the City Commission of Miami:

The acCOMpanyinR Plat entitled COMET SUBDIVISION was
prepared by George Tbarra. It is in correct form for submission
to the City Commission and is forwarded with a recommendation
that It be approved.
PERTINENT INFORMATION REGARDING THE PLAT:
(1) The property platted is a portion of a lot in a prevIeusly H
pLatted subdivision: It will consist of one lot zoned R-2.
(2) The location of the streets and the widths conform with the
Standards of the Department of Public Works of the City of
Miami, Florida.
As certified to by George Ibarra, Registered Land Surveyor,
tits Pint complies with the plat filinr laws of the State
or Florida.
(4) J!y authority of Resolution No. ZB 168-76, adopted October 4,
976, the Plat was recommended for acceptance by the City Zoning
'Board of Miami.
(5) The attached Certificate of Title Examination dated December 1,
1976, signed by Carlos Lidsky, Attorney, indicates that the fee
simple title to the property platted is correctly vested in
Leonel Alonso and Miriam G. Alonso, his wife, and the Plat has
been correctly executed.
(6) The area platted is encumbered by a mortgage and the mortgage
holder has executed the Plat and joined in its dedications.
(7) In accordance with the requirements of Chapter 54, Section
54-20, of the Code of The City of Miami, a Cashier's Check
in the amount of $1,700.00 has been tendered by the owner,
Leonel Alonso and Miriam G. Alonso, his wife. This Cashier's
Check has been deposited with the Director of Finance and
will guarantee the completion of the subdivision improvements
according to the provisions of the Agreement between The City
of Miami and the aforementioned Leonel. Alonso and Miriam G.
Alonso, his wife. The improvements reauired at the property
platted are listed as follows: Landscapinr, water mains and
appuvtances, grading and shaping of street shoulder and fill.
