This letter is addressed to me here at the Planning Advisory Board and states "Dear Mrs. Rockafellar: I am enclosing herewith a copy of a letter received from the Planning Department with reference tO my absence from the Board meeting. I have written to Mr. Acton explaining I should not be penalized for the absence of the meeting that wi1J. take place T?oveeibea: leLh, 1976. inthat letter I mentioned that I had arranged a business trip to the Far East and would not be able to attend the scheduled meeting r,f_ November 3rd. At a later date, the Board voted to re -schedule the meeting of November 17th to November 10th so that the members attending the Clearwater convention would not miss a regular P. A. B. meeting. As you can see, by re -scheduling the meeting of the 17th, I have been adversely affected and will now stand to be automatically dismissed in accordance with the P.A.B. Charter. In all fairness, I think an exception shou1,1 be taken so that my absence of the meeting of the 10th will not be taken on to my records. I have served the Board since its initiation. I feel that we have done together a tremendous job. I would like to keep my position on the Board and serve for the remainder of my term as I have done in the past. ISIDRO C. BORJA" I am going to give my own opinion and see if the Hoard will agree and if they would care to make a motion. I personally am very happy that the meeting was set up to the 10th so that the three members attending the Clearwater meeting will not miss the meeting. On the other hand, since Mr. Borja had made his meetings in advance realizing he had missed one Planning Board meeting, and this would be, if he went on the 10th as he explained to me on the phone, he would have returned the 16th end then back in time for the second meeting and missing the one extra meeting would have come within his two oxcused meetings for the year. I personally feel that it's not fair to punish tar. Borja since this is no faulc of his own. The meeting was changed which we were happy to do, to accommodate the other three members. But I don't think in the meantime, he should be punished. I would suggest that this Board make a :notion by making a recommendation to the City Commission that under the conditions :xleting in this letter (I'll be glad to leave the letter with you) that nr. The scheduling we originally received was for the 17th and i•ir. Borja predicated his personal plans on that schedule and it has been changed. I feel that Mr. Borja should not be penalized for a schedule that was changed by the Board to accommodate three members to attend a conference in Clearwater because he would have not missed the meeting if we had gone by the original schedule. Mrs. Rockafellar: That was my point Mrs. Lichtenstein. Mrs. Alexander: I agree with everything that has been said before. However, I don't know why we changed the meeting anyway. There were three of us going; we were going on City business; we would all have had excused absences and there would have been a quorum. I think Mr. Borja is absolutely right. If you want a motion for us to forward to the Commission on this basis? !firs. Rockafellar: 1 would hate to see any Board member penali_ze6 for something that is no fault of their own. These two excused absences are restricting enough. :ors. Alexander: Is it on the basis of this meeting? Is this his third meeting that he's missing? Mrs. Rockafellar: He will be by missing the 10th. If the meeting had stayed as scheduled on the 17th, he would have only missed one and he would have been within his two excused absences. Mr. McManus: Tonight is his second meeting. Mrs. Rockafellar: If the Board is in agreement I would lake to have a motion. Mrs. Fernandez: I'm ready for a motion because I have always considered two absences as quite restrictive and particularly in this case when he made his plans believing we were to have a meeting on the 17th then have it changed, when there wasn't any real basic reason because all those who are planning to attend the Clearwater meeting would have a very valid excuse. But also we didn't want to have a non -quorum meeting, I think was the main reason. But this put Mr. Borja in a very difficult situation and it's something he couldn't change in a short period of time, so I'm ready to move that we request from the City Commission to excuse Mr. Borja from this meeting and not have this count as an absence in connection with his regular attendance at the Planning Advisory Board meetings. I have one of those occupations where I get two and three clay notices, that I might not be able to come in as we talked about in the workshop. This is my occupation - on the job - I'm in charge of a certain group. I'm having problems for the loth now and with Mr. Torja not being able to come in, I know the City business must go on, but I have one of those situations where next Wednesday I'm scuffling to try to get here as an Alternate in Mr. Borja's place. So sometimes t don't care how far in advance you plan, things in my occupation come up where I have to be there. Most likely I would try to wrangle out of it, but this is what we mentioned in the meeting a couple of weeks ago that was held at the Parks and Recreation Department. I wouldn't think aboutmissing a meeting and not having a quorum, but sometimes it is almost impossible on my job. When the Principal says "we need you there to answer questions by parents" then I've got to go. Mrs. Rockafellar: Your job conflicts with the Board. You see, that wasn't Mr. Borja's reason. Mr. Do ja had planned his trip that he has to go on for, the Company to coincide with the meeting, Mrs. Ofelia Fernandez offered the following motion and moved its adoption: MOT ION : MOVE THAT WY REQUEST THE CITY COMMISSION TO EXCUSE MR. BORJA'S ABSENCE FROM THE MEETING OF NOV3MBER 10 , 197 6 AND NOT HAVE IT COUNTED IN CONNECTION WITH HIS REGULAR ATTENDANCE AT PLANNING ADVISORY BOARD MEETINGS. Upon being seconded by Mrs. Selma Alexander this motion was passed and adopted unanimously. AYES: Mmes. Alexander, Fernandez, Lichtenstein, Rockafellar Messrs. Dannenberg, Smith, Rolle NAPES: None Mr. McManus: Motion passes 7 - 0. Mr. McManus: For the information of the Board, should Mr. Borja not be at the next meeting the Department will prepare a letter for the Chairperson's signature which then goes on to the Commission. We have to be prepared for that eventuality, so there will be a letter prepared for Mrs. Rockafellar's signature as Chairperson of the Planning Advisory Board informing the City Commission that Mr. Borja has in fact missed his three meetings. Under terms of the City Code Chapter 62, Section 62.22, a crier ber is automatically removed for missing more than two meetings. At that time, it would be appropriate for the Commission to consider either a) re -appointing Mr. Borja to fill the remainder of his unexpired term of appointment through calendar year 1978; or b) appointing a new member to fill the vacancy from the list of candidates available at that time. Ongie City Clerk City Hall Miami, Florida 33133 Dear Mr. Ongie: As required by the Miami City Code, Chapter 62, Section 62-22 and 62.23, it is my obligation, as Chairperson of the Miami Planning Advisory Board to inform you that Mr. Isidro Borja, a member of the Planning Advisory Board, has missed the meetings of November 3rd and loth, 1976, which, coupled with a previously unexcused absence of April 21, 1976, automatically removes Mr. Borja from the Planning Advisory Board. The Miami City Code, Chapter 62, Section 62-22 Removal, paragraph b states: "A member of the Planning Advisory Board and of the Zoning Board shall automatically be removed for missing more than two (2) regularly scheduled meetings during the calendar year without an excused absence. For the purpose of this article an excused absence shall be defined as illness, death in family or away on City business." Further, Section 62-21 Vacancies of the same Chapter of the City Code states, in part: "It shall be the duty of the Chairman of the Planning Advisory Board or the Chairman of the Zoning Board, as the case may be, to notify the City Clerk within ten (10) days after a vacancy occurs, and the City Clerk shall promptly transmit such informa- tion to the City Commission for appropriat e Commission action as set forth herein." It is now appropriate for the City Commission to consider an appointment for the remainder of Mr. Borja's term of appointment through calendar year 1978. Mrs Ralph G.
