ORDINANCE NO.
AN ORDINANCE AMENDING ORDINANCE NO. 6871, THE
COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF
MIAMi, BY CHANGING THE ZONING CLASSIFICATION
OF CERTAIN PROPERTIES GENERALLY LOCATED ON AND
ADJACENT TO MARTIN LUTHER KING JR. BOULEVARD,
FROM I-95 TO N.W. 17TH AVENUE, PRESENTLY ZONED
R-4 (MEDIUM DENSITY MULTIPLE), C-1 (LOCAL
COMMERCIAL), C-2 (COMMUNITY COMMERCIAL), AND
C-4 (GENERAL COMMERCIAL), TO C-4A (BOULEVARD
COMMERCIAL) DISTRICT; ADDING A DESIGNATION OF
TRANSITION USE AREA TO CERTAIN CONTIGUOUS
AREAS PRESENTLY ZONED R-1 (ONE FAMILY), R-2
(TWO FAMILY) AND R-3 (LOW DENSITY MULTIPLE),
ALL AS SHOWN ON THE MAP ATTACHED HERETO; AND
BY MAKItiG THE NECESSARY CHANGES IN THE ZONING
DISTRICT MAP MADE A PART OF THE SAID ORDINANCE
NO. 6871 BY REFERENCE AND DESCRIPTION IN
ARTICLE III, SECTION 2 THEREOF; BY REPEALING
ALL ORDINANCES, CODE SECTIONS, OR PARTS
THEREOF IN CONFLLCT; AND CONTAINING A SEVER-
ABILITY PROVISION.
WHEREAS, the Miami Planning Advisory Board at its meeting:
ember 10, 1976, Item No. 2, following an advertised hearing,
adopted Resolution No. PAB 32-76 by a 6 to 0 vote recommending
changing the zoning classification as hereinafter set forth; and
WHEREAS, the City Commi.:.:ion, after careful consideration
and due deliberation of this :natter, deems it advisable and in the
best interest of the City of Miami and its inhabitants to grant
said petition;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, the Comprehensive Zoning'
Ordinance for the City of Miami be, and the same is hereby amended
by changing the zoning classification of certain properties
generally located on and adjacent to Martin Luther King Jr.
Boulevard, from I-95 to I.W. 17th Avenue, presently zoned R-4
(Medium Density Multiple), C-1 (Local Commercial), C-2 (Community
Commercial), and C-4 (General Commercial), to C-4A
(Boulevard Commercinl)Distri.ct; adding a designation of Trans-
sition Use Area to certain contiguous areas presently zoned R<l.
(One Family), R-2 (Two Family) and R-3 (Low Density Multiple),
all as shown on the map attached hereto; and by making the nPcessj
changes in the Zoning Dist:ict Map made a part o, the said Orditance
No. 6871 by reference and description it Article III, Section 2 thereof,
Section 2. That all laws Or parts of laws it conflict
herewith be, and the sate are hereby repealed itsofar as they are
it conflict.
Section 3. Should any part or provision of this orditance
be declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of the ordinance as a whole.

Initiated by Planning Department
The Miami Planning Advisory Board, at its meeting of November 10, 1976,
Item #2, following an advertised Hearing, adopted Resolution No.
PAB 32-76 by a 6 to 0 vote (2 members absent) Recommending Changing
the Zoning Classification of certain properties generally located on
and adjacent to Martin Luther King Jr. Boulevard, from I-95 to N. W.
17th Avenue, presently zoned R-4 (Medium Density Multiple), C-1
(Local Commercial), C-2 (Community Commercial), and C-4 (General
Commercial), to the proposed C-4A (Boulevard Commercial) District;
adding a designation of Transitional Use to certain contiguous areas
presently zoned R-1 (One Family), R-2 (Two Family) and R-3 (Low
Density Multiple), all as shown on the attached maps.
Twenty -Two objections were received in the mail. Four objectors
were present at the meetings.
An ORDINANCE to provide for these Changes of Zoning has been prepared
by the City Attorney's office and submitted for consideration of the
City Commission.
