C,-1 Local Commercial Change of Zoning Classification from C..1 (Local Commercial) to C-4 (General Commercial) The request is to permit the use of the easterly portion of the site to be used for an automotive repair and upholstery facility requiring a C-4 zoning classification, in conjunction with the sale and display of new automibles, a permitted use in the C-1 zoning district, immediately adjacent and within the same building as the sales and display facility. When the building permit for alteration of the subject building was issued, the applicants erroneously assumed that the sale and display of new automobiles would allow automotive repair. They were subsequently advised that automotive repair facilities required a change in zoning. The applicant has transmitted a covenant excluding lots 6 and 7, restricting use of the property to those uses permitted in the C-1 District and those stated accessory uses (Repair and upholstery service) for a period not less than thirty (30) years. In addition the applicant has submitted an agreement to the following: • 1) Submission of a landscaping plan for the building located on lot 3 which meets with City approval. • S) The applicant will not utilize the alley immediately to the rear of the subject property for egress or ingress to repair and upholstery service areas 4) The applicant will include an opening in the west Wall of existing building for movement of serviced vehicles between the building and parking area RECOMMENDATIONS PLANNING IDEPAI1TMENT ZONING BOARD COMMUNITY REACTION DENIAL: The zoning change from C-1, Local Commercial to C.4, General Commercial would permit the establishment of several incompatible land uses that could adversely affect residential development in the immediate area. The application, if granted, would exclude residential develop- ment that should be encouraged in proximity to Biscayne Boulevard. The accessory uses of automotive repair and upholstery service would not be incompatible in the C-1 district if appropriately located and operated and when the use is clearly incidental to the sales and servicing of new automobiles. Therefore, it is recommended that the district use regulations (C-1) be amended to permit auxiliary repair and service as a conditional use, and that the amendment be referred to the Planning Advisory Board for consideration. Recommended Denial by Resolution #ZB 176-76, November 1, 1976, by a 3-3 vote, one member absent. Recommended by Resolution #ZB 177-76, November 1, 1976, that the Planning Department study the possibility of permitting auxiliary repair and service uses as a Conditional Use in the C-1 district by a 6-0 vote. E. 20th Terrace Lots 3 thru 7, Block 3; BAYSIDE PARK AND (2-40) Applicant: Braman Cadillac Gentlemen: The Miami Zoning Board, at its meeting of Uovh;nb r 1, 1976, Item #2, following an advertised Hearing, offered a Motion to recommend a Change of Zoning on Lot 3 and the N10' of Lots 4 thru 7, Block 3, E YSIDE PARK N D (2-40) from C-1 (Local Commercial) to C-4 (General Commercial) by a vote of 3 to 3. A TIE VOTE CONSTITUTES A DENIAL; therefore Resolution No. ZB 176-76 was adopted recommending DENIAL of the petition for a Change of Zoning Classification of Lots 3 thru 7. Block 3. I3AYSIDE PARR AHD (2-40), being approximately 255 N. E. 20th Terrace. from C-1 (Local Commercial) to C-4 (General Commercial) . No objections were received in the mail. One objector to this item was present at the meeting. An ORDINAr10E to provide for this Change of Zoning has been prepared by the City Attorney's office and submitted for consideration of the City Commission.
