A RESOLUTION OF TIM CITY COMMISSION GRANTING
PERMISSION TO FILL SUBMERGED LAND OWNED BY'TRE
APPLICANT LYING BETWEEN THE CURRENT PROPERTY
LINE AND THE FORMER DADE COUNTY BULKHEAD LINE
Ab3ACENT TO LOTS 46 THROUGH 50, BLOCK B, FLAGLER
MARY BRICKELL (5-44), BEING 1627 AND 1643
BRICKELL AVENUE AND LOTS TO THE SOUTHWEST, USING
UPLAND FILL; PROVIDED, HOWEVER, THAT NO FILL
PERMIT SHALL BE ISSUED BY THE PUBLIC WORKS
DEPARTMENT UNTIL AND UNLESS THE APPLICANT HAS
RECEIVED APPROVAL FOR SAID FILL FROM
THE STATE OF FLORIDA AND THE U.S. ARMY CORPS OF
ENGINEERS AND FINAL SITE PLANS HAVE BEEN APPROVED
BY THE APPROPRIATE CITY OF MIAMI BOARDS AND THE
CITY COMMISSION.
WHEREAS, the Miami Zoning Board, at its meeting of
eptember 13, 1976, Item No. 5, following an advertised hearing,
adopted Resolution No. ZB 141-76 by a 6 to 0 vote (1 member
abstained), recommending the request for permission to fill sub-
merged land adjacent to Lots 46 through 50, Block B, Flagler
Mary Brickell (5-44), being 1627 and 1643 Brickell Avenue and
lots to the Southwest; and
WHEREAS, the Commission after due deliberation and
careful consideration of the application deems it in the public
interest to permit the filling of the submerged lands subject to
the conditions set forth herein; "DOCUMENT INDEX
NOW, THEREFORE, BE IT RESOLVED BY TKEL1YSSNefPHE
CITY OF MIAMI, FLORIDAA:
Section 1. The application for permission to fill
submerged land owned by the applicant lying between the current
property line and the former Dade County bulkhead line adjacent
to Lots 46 through 50, Block B, Flagler Mary Brickell (5-44),
being 1627 and 1643 Brickell Avenue and lots to the Southwest,
using upland fill; provided, however, that no fill permit shall
be issued by the Public Works Department until and unless the
applicant has received approval for said fill from
the State of Florida and the U.S. Army Corps of Engineers and
final site plans have been approved by the appropriate City of
Miami boards and the City Commission, be and the same is hereby
