A RESOLUTION AUTHORIZING AND DIRECTING THE CITY
ATTORNEY TO SETTLE PARCEL NO. 7095-6 IN CITY OP
MIAMI V. GISELE FASHIK, CIVIL ACTION NO. 74-21840
(AFRICAN SQUARE PARK), FOR $17.350.00, EXCLUDING
COSTS AND ATTORNEYS' FEES, AND AUTHORIZING AND
DIRECTING THE FINANCE DIRECTOR TO ALLOCATE THE
SUM OF $1,100.00 FROM THE 1972 PARKS FOR PEOPLE
BOND FUNDS AND TO PAY SAID SUM TO THE CLERK OF
THE CIRCUIT COURT.
WHEREAS, the City of Miami filed a condemnation action
he African Square Park project; and
WHEREAS, the court has entered an Order of Taking a'ttd
the sum of $16,250.00 has been paid to the Defendant, SUPERIOR
OIL COMPANY; and
WHEREAS, the Defendant has agreed to a settlement of
$17,350.00, exclusive of costs and attorneys' fees; and
WHEREAS, the City Commission finds that said sum repre-
sents a reasonable settlement;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the City Attorney be and he is hereby
authorized and directed to settle Parcel No. 7095-6 in City of
Miami v. Gisele Fashik, Civil Action No. 74-21840 (African Square
Park), for $17,350.00, excluding costs and attorneys' fees.
Section 2. That the Finance Director be and he is
hereby authorized and directed to allocate the sum of $1,100.00
from the 1972 Parks for People Bond funds and to a said_s m

February of 1975. Under our present condemnation procedures,
