The Commission of the CitlTc� A i-- - (hereinafter sometimes called the "City Commission") has '.round and determined and does hereby declare that: (a) The City Commission on July 22, 1976 duly opted Ordinance No. 8571 authorizing the issuance, sub ect to the election therein provided for, of bonds of he City of Miami, Florida, in an aggregate principal mount not exceeding $10,000,000 for the purpose of pay- g,the cost of fire fighting, fire prevention and rescue facilities in the City of Miami, including the construc- ng, reconstructing and improving of fire stations in City of Miami, administration building, other struc- equipment, vehicles and communication systems re- lated to the training, administration and operations of the fire department and the acquisition of any necessary. and and equipment related thereto, and on July 22, 1976 duly adopted Ordinance No. 8574, providing for the holding >f`an election on September 28, 1976 for the purpose of ubmitting to the qualified electors of the City of Miami the•question whether said $10,000,000 bonds should be issued. (b) Notice of said election was duly published in the EX manner and for the time required by law, and Inspectors and Clerks of Election were duly appointed and their names pub= ished`as required by law. Section 2. For the purpose of paying the cost of fire fighting, fire the City of Miami, ting and improving prevention and rescue facilities in including the constructing, reconstruct of fire stations in the City of Miami, administration building, other structures, equipment, vehi- cles and communication systems related to the training, administration and operations of the fire department and the acquisition of any necessary land and equipment, there shall be issued the negotiable coupon bonds of the City of Miami, Florida, in the aggregate principal amount of Ten Million Dollars ($10,000,000), to be designated "Fire Fight- ing, Fire Prevention and Rescue Facilities Bonds" and to consist of 2,000 bonds of the denomination of $5,000 each. Section 3. Both the principal of and the interest on said bonds shall be payable at a bank or trust company in the Borough of Manhattan, City and State, Of New York, or at a bank or trust company in the City of Chicago, Illinois, or at a bank or trust company in the City of Miami, Florida, at the option of the holder or registered owner, in any coin or currency of the United States of America which, at the respective dates of payment thereof, is legal tender for the payment of public and private debts. Section 44. Said Fire Fighting, Fire Prevention and Rescue Facilities Bonds shall be signed by the Mayor of the City of Miami by his facsimile signature and by the City Clerk, and a facsimile of the seal of the City shall be imprintedon the bonds. The interest coupons to be attached to the bonds shall be executed with the facsimile signature the City Clerk. In case any officer whose signture or a acsimile of whose signature shall appear on any bonds or coupons shall cease to be such officer before the delivery f such bonds, such signature or such facsimile shall never- heless be valid and sufficient for all purposes the same as 'f he had remained in office until such delivery, and any bond may bear the facsimile signature of, or may be signed by, such persons as at the actual time of the execution of such bond shall be the proper. officers to execute such bond although at the date of such bond such persons may not have 1 een such officers. Pursuant to the provisions of the Charter the City of Miami and of said Ordinance No. 8571 there hall be levied and collected upon all property within the ty of Miami subject to taxation for such purposes, in each year while any of said Fire Fighting, Fire Prevention and Rescue Facilities Bonds shall be outstanding, a special tax sufficient to pay the principal of and the interest on said bonds as the same respectively become due and payable, and to provide for probable failures of collection of such tax in such year. Such tax shall be levied and collected at the ame time and in the same manner as ad valorem taxes levied or operating expenses of the City and shall be in addition o all other taxes authorized to be levied by the City of mi. The City covenants that it will not accept payment taxes levied for operating expenses of the City unless here shall be paid at the same time the tax levied to make incipal and interest payments required by thl.S resol.u- Section 8.
