HomeMy WebLinkAboutR-76-1057A/ts 10/28/16 RESOLUTION NO: 764051 RESOLUTION AUTHORIZING AND DIRECTING TITS CITY MANAGER AND CITY CLERIC TO ENTER INTO AN AGREE= MENT BETWEEN THE CITY OF MIAMI AND DADE COUNTY PROVIDING THAT THE HOUSING AND URBAN DEVELOPMENT DEPARTMENT OF DADE COUNTY SHALL PROVIDE THE ADMINISTRATIVE WORK REQUIRED IN THE ACQUISITION AND CONDEMNATION OF PORTIONS OF THE MARTIN LUTHER p\r KING, JR. BOULEVARD TO BE USED FOR CITY PARKS, ��SU P �' JUTE V APPRAIISALSINCLUDING REAL ESTATE AND RELOCATIONUOFITION, TENANTSROCESSING OF DOCU M NTS FOLLOW" WHEREAS, the City of Miami does not have a Real Estate Acquisition Section that is thoroughly familiar with the guide- lines required by Federal projects; and WHEREAS. it has been determined that the Condemnation of Martin Luther Ring, Jr. Boulevard must proceed in accordance with Federal Regulations since Federal money was used in plan- ning of the entire linear park on Martin Luther King, Jr. Boulevard; and WHEREAS, the Dade County Housing and Urban Development Department is thoroughly familiar with the Federal require- ments hereinabove referred to; and WHEREAS, the Dade County Housing and Urban Development 'Department is willing to handle the administrative work re- quired for the Martin Luther King, Jr. Boulevard condemnation as more fully set forth in the Agreement attached hereto and made a part hereof; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE .CITY OF MIAMI, FLORIDA: "DOCUMENT, INDEX Section 1. Additions] parcels may be added by letter from the City Manager's Office, and acknowledged in writing by the County Manager's office. Recommendations as to prices to be offered shall be made in writing by the Real Estate Acquisition Officer of }BUD with the expressed under- standing that all offers, letters to owners, and/or changes in the offered prices shall be fully documented in his files and shall have the written concurrence of the City Manager of the City of Miami or his designated agent. Taw _Attached hereto is the above captioned agreement and resolution approving same. 'inc. originally pcoposed ciLeement provided that the County Attorney's Office would handle all legal work; however, since the County's condemnation procedures have recently come under mnfliJ, T1;, T 1 Cit file it own actions in eminent domain. I am, therefore, recommending the agreement attached hereto, which provides that Dade County HUD shall process appraisals, perform title work and perform other functions necessary to the preparation of each parcel to be acquired.
