RESOLUTION AUTHORIZING AND DIRECTING TITS CITY
MANAGER AND CITY CLERIC TO ENTER INTO AN AGREE=
MENT BETWEEN THE CITY OF MIAMI AND DADE COUNTY
PROVIDING THAT THE HOUSING AND URBAN DEVELOPMENT
DEPARTMENT OF DADE COUNTY SHALL PROVIDE THE
ADMINISTRATIVE WORK REQUIRED IN THE ACQUISITION
AND CONDEMNATION OF PORTIONS OF THE MARTIN LUTHER

WHEREAS, the City of Miami does
not have a Real
Estate
Acquisition Section that is thoroughly familiar with the guide-
lines required by Federal projects; and
WHEREAS. it has been determined that the Condemnation of
Martin Luther Ring, Jr. Boulevard must proceed in accordance
with Federal Regulations since Federal money was used in plan-
ning of the entire linear park on Martin Luther King, Jr.
Boulevard; and
WHEREAS, the Dade County Housing and Urban Development
Department is thoroughly familiar with the Federal require-
ments hereinabove referred to; and
WHEREAS, the Dade County Housing and Urban Development
'Department is willing to handle the administrative work re-
quired for the Martin Luther King, Jr. Boulevard condemnation
as more fully set forth in the Agreement attached hereto and
made a part hereof;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE

City of Miami and Dade County providing that the Housing and
Urban Development Department of Dade County shall provide
the administrative work required in the acquisition and con-
demnation of portions of the Martin Luther King, Jr. Boulevard
o be used for City parks, including real estate acquisitions,

e terms and conditions of this Agreement are as follows:
1 Dade County HUD shall, through its Rea] Estate Ac-
iaition Section, }'I occ:.:; the appraisals, title work, and
all other functions necessary to the preparation of each
parcel to be acquired, to be included in eminent domain pro-
ceedings which shall be coordinated through the City of Miami
Department of Law if all required negotiations are not success--
'ful. The parcels to be acquired are

per sketch attached hereto. Additions] parcels may be
added by letter from the City Manager's Office, and acknowledged
in writing by the County Manager's office. Recommendations as
to prices to be offered shall be made in writing by the Real
Estate Acquisition Officer of }BUD with the expressed under-
standing that all offers, letters to owners, and/or changes in
the offered prices shall be fully documented in his files and
shall have the written concurrence of the City Manager of the
City of Miami or his designated agent. All payments will be
made by City of Miami warrant, no funds of HUD being involved,

ating individuals, families, and businesses from the subject
operty in accordance with the Uniform Relocation Assistance
and Real Property Acquisition Policies Act of 1970, Public
Law 91-646, and, in accordance with any directives, and/or
pbliCy determinations as may be promulgated from time to time
by the U. S. Department of Housing and Urban Development.
Recommendations as to payments shall be made in writing by the
Assistant Director for Urban Development and shall be forwarded
to the City Property Manager for concurrence and processing.
All payments will be made by City of Miami warrant, no funds

The City will grant to the County the right-of-way
squired from city -owned lands for the roadway improvements
and adjacent buffer strips on the Martin Luther King, Jr.
Boulevard Project as they become necessary. The right-of-way
and buffer strip areas will be maintained by the County.
In witness whereof, the undersigned have executed this
Agreement as of the date written above.

_Attached hereto is the above captioned agreement and
resolution approving same.

since the County's condemnation procedures have recently come

actions in eminent domain. I am, therefore, recommending the
agreement attached hereto, which provides that Dade County
HUD shall process appraisals, perform title work and perform
other functions necessary to the preparation of each parcel
to be acquired.
