A MOTION RECONFIRMING THE CITY COMMISSION'S COMMITMENT
TO THE PEOPLE OF THE GRAPELAND HEIGHTS AREA NOT TO
ALLOW ACCESS TO THE CENTRAL SHOPPING PLAZA ON NW llth
STREET FOR AUTOMOBILES, AND REQUESTING THE ADMINISTRA-
TION TO COOPERATE IN EVERY WAY POSSIBLE WITH THE REPRE-
SENTATIVES OF THE CENTRAL SHOPPING PLAZA IN AN EFFORT
TO ACCOMPLISH THE WIDENING OF THE EXISTING OPENING ON
NW 37TH AVENUE AS MUCH AS POSSIBLE.
The minutes of said meeting reflected that the Commission would review
this action in October.
EXPLANATION
The original approval for Central Shopping Plaza required a landscaped
buffer and rear walls along NW llth Street and NW 39th Avenue prohibiting
any access to these two streets from the shopping plaza, except adjacent
to NW 7th Street.
A public hearing was held by the City Commission on September 12, 1974,
to consider a bank and drive-in teller facility; the Planning Department and
the Zoning Board recommended an opening for egress only onto NW llth
Street at 38th Avenue. At this hearing many local residents and the Grape -
land Heights Civic Association were opposed to any additional access
openings to the north or west. The Commission approved the application
by Resolution 74-970 which stated:
A RESOLUTION APPROVING THE MODIFICATION OF CENTRAL
SHOPPING PLAZA DEVELOPMENT ON TRACT "A", CENTRAL
SHOPPING PLAZA (68-79), LOCATED AT APPROXIMATELY
3875 NW SEVENTH STREET, AS PER ORDINANCE No. 6871,
ARTICLE XIII, SECTION 4, TO INCLUDE AN EIGHT -STORY
BANK AND OFFICE STRUCTURE, AS PER MODIFIED PLAN,
DATED AUGUST 6, 1974; ZONED C-1A (PLANNED SHOPPING
CENTER); THAT THIS APPLICATION BE GRANTED WITH THE
FOLLOWING STIPULATIONS: 1. THAT THE WALL WHICH
EXISTS BE RAISED TO A LEVEL OF 6 FEET: 2. THAT THE
LANDSCAPING BE ADEQUATE TO HIDE THE WALL FROM THE
OUTSIDE VIEW: 3, THAT ANY EGRESS TO THE NORTH SHALL
1LRMITTED TO EXIT ON 37th AVENUE: 4. THAT THERE
BE COMPLIANCE WITH THE CODE AS TO LIGHTING AND ADE..
OtUATE DRAINAGE: 5. THAT ALL OF THE ABOVE SHALL BE
SUBJECT TO REVIEW TWELVE (12) MONTHS FROM THE DATE OFF
OCCUPANCY.
The Public Hearing on June 17, 1976, was pursuant to the owners and
Merchants of Central Shopping Plaza requesting a change in the conditions
arid limitations imposed on Central Shopping Plaza by the City. The proposed
change was to permit one or more opening's for ingress/egress to NW llth
Street to facilitate traffic movement for two operations which have been added
to the shopping center since its original development. These are a Florida
State Drivers License Station and a bank drive-in teller operation.

RECOMMENDATION
It is felt that additional signalization in the area would not be helpful, but that
the relatively minor degree of difficulty in certain areas of the center could be
reduced by allowing access between llth Street and the northern isolated part
of the center. (October 22, 1976)

it is recommended that Ito opening be permitted onto NW 11th Street, bat
that the following actions be initiated to improve the existing access and
traffic circulation associated with the State of Florida Division of Drivers
License Station:
1. Relocate the existing driveway along NW 37th Avenue northerly of its
present location in accord with the previously approved plan for the
shopping center.
Access aisles from the relocated opening on NW 37th Avenue and from
the existing opening on NW 39th Avenue be properly lined, marked and
identified indicating appropriate diroctions leading to and from the
Drivers License Station.
Active loading and unloading areas for the shopping center be properly
marked and identified so as not to encroach upon the aforementioned
access aisles.
The driveway at NW 39th Avenue be redesigned so as to eliminate some
of the turning conflict created by having two outbound lanes, one from the
drive-in teller and one from other areas of the shopping center.
On -street parking be prohibited in close pro:~unity to the driveway on
NW 39th Avenue so as to provide better vision clearance for vehicles
exiting the shopping center.

Internal shopping center traffic prohlehs encountered by the Drivers Dieense
Bureau initiated the request for an additional opening to NW I lth Street.
Site inspections of the 37th Avenue exit, adjacent to the rear of the Grand
Union Supermarket, indicate considerable: conflict between entering and
exiting traffic and the trucks that are unloading and loading at the rear of the
supermarket. The existing driveway is too close to the loading activities for
safe traffic movement. The driveway should be located northerly, as shown
on the stropping center's most recent approved plan.
The existing parking areas through which one must travel to reach the Division
of Drivers I.,icenses are poorly marked with no defined access aisle. Parking
occasionally overflows into the intended aisles causing rerouting of moving
traffic into non -aisle areas. Properly lined, marked and channelled access
aisles would eliminate these traffic conflicts.

Loading and unloading occur randomly along the rear of the center, often con•
flicting with traffic circulation and parking. These areas should be clearly
delineated and separated from other vehicle activities.

entering 39th Avenue. Both lanes presently turn right or left causing this
condition, which could be eliminated by rechannelling the drive-in teller lane,
into the other outbound lane, before reaching 39th Avenue.
The vision clearance adjacent to the 39th Avenue exit is very poor due to the
adjacent on -street parking. A minimum no parking area of 30 feet on each
side of the driveway would improve the vision clearance.
The Division of Drivers Licenses accommodates on the average of 110 driving
tc sts per day and accommodates approximately 500 applicants including those
taking drivers tests each day. The recommended improvements would provide
safer, more efficient ingress and egress for both the driver testing and services,
and other visitors to the shopping center.

required by law for approval change to shopping plaza'a. The Commission granted

more conditions to the situation including closing of the opening through the
'tall on theNorth side of the property to N.W. IIth street and allowing only
access to the north through 37th avenue. So at this paint the wall has been
Constructed and there is no access to N.W.11th Street or anyplace to the north
except onto N.W. 37th Avenue as provided for by this Commission. A little
while ago people interested in opening this wall rote a letter to the City
`iznager asking for a personal appearance before the City Commission to see if
you could re-considerathis resolution that you wrote closing this wall. This

ation a Resolution 74-970 , which granted the permission to have this bank in
Central Shopping Plaza attaching several conditions including the closure and
keeping closed of the wall on N.W. llth Street.

of legal technicality than anything. As I recall when permission was given for
the bank to constructed. One of the conditional uses placed upon that was a
closing of the wail. Now, if I understand correctly at this public hearing we
cannot change that.
Yr. Bob Davis : I believe this would be up to the law department, because I
believe you can change the resolution Mr. Plummer, you can revise the resolution.
ir. Plummer: Alright, I'm just asking for legality because as I understand the
law we could not make any changes today, it would have to go back befo:ethe
Zoning Board from whence it came.
4r. Bob 'Davis - If the conditions were put on by this Mr. Plummer put on
by the Commission, this came up to the Commission with an opening in the wall.
The Board only made a recommendation on this item. This is a situation that the
Commission has final approval oa. It just a natter of revising the resolution
itself if you so wish.
