"D" - 253, UNPLATTED, BEING 3495 MAIN HIGHWAY, BEING THE EASTERLY 21 UNITS OF SITE PLAN ON FILE, SUBJECT TO PLATTING OF PROPERTY, ZONED R-1B (ONE FAMILY), PROPOSED TO BE REZONED R-1 (ONE FAMILY), GRANTED BY CITY COMMISSION RESOLUTION "SUPP0....mTivE NO. 76-559. DOCIM1FNIS FOLLOW" WHEREAS, Article XXXII of the Comprehensive Zoning Ordinance No. 6871 permits an extension of a conditional use by the City Manager with approval by the City Commission, for a one-year period; and WHEREAS, the City Manager recommends a one-year extension of the conditional use granted by City Commission Resolution No. 76-559; NOW, THEREFORE, BE IT RESOLVED BYTT6baltifirIfibn TIE CITY OF MIAMI, FLORIDA: ITEM NO. The request for a one-year extension of the conditional use Planned Area Development (PAD) as listed in Ordinance No. 6871, Article XXI-1, consisting of twenty-one (21) single family cluster -type units, on site known as Ne'ly 99.50 feet of Lot 9, D.B. "D" - 253, unplatted, being 3495 Main Highway, being the Easterly 21 units of site plan on file, sub- ject to platting of property, zoned R-1B (one family), proposed to be rezoned R-1 (one family), granted by City Commission Resolution No. 76-559, be and the same is hereby granted. October 27, 1976 6UOJECt: REKERENCE9: ENCLOSURES: UNPLATTEb 3495 Maim Highway PILL: ARTICLE XXXII of the Comprehensive Zoning Ordinance No. 6871 provides that any Conditional Use shall expire six months after the effective date of the Conditional Use unless a Building Permit or a Certificate of Use has been issued based upon the Conditional Use. The Ordinance further provides that the City Manager may, after reveiw and deter- mination that substantial progress has been achieved by the applicant in terms of project planning, extend the expiration date of the Conditional Use for an additional period of time not to exceed one year, subject to approval of the City Commission. This Department finds no objection to the granting of the extension of time for this Conditional Use. We are requesting the City Attorney's office, by copy of this memo, to prepare the proper Resolution for this extension. WHEREAS, the Miami Zoning Board at its meeting of May 3, 1976, Item No. 7(b), following an advertised hearing, adopted Resolution No. ZB 89-76 by a 6 to 1 vote recommending approval of a Planned ARea Development (PAD) as hereinafter set forth; and WHEREAS, the City Commission deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant the petition for the application of a Planned Area Development (P1); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The petition for a Planned Area Development (PAD) as provided in Ordinance No. 6871, Article XXI-1, consisting of twenty-one single family cluster -type units, on site known as NE'ly 99.50 feet of Lot 9, D.B.
