TO HOME INVESTMENT PARTNERSHIPS PROGRAM
LOAN AGREEMENT FOR VILLA JARDIN II APARTMENTS
This Amendment ("Amendment") to the HOME Loan Agreement dated February 5, 2016
("Loan Agreement") is entered into on the day of , 2020 between the City
of Miami, a municipal corporation of the State of Florida ("City"), and Little Haiti Housing
Association, Inc., a Florida not for profit corporation, d/b/a Haitian American Community
Development Corporation ("Project Sponsor").
RECITALS
WHEREAS, the Project Sponsor is rehabilitating six (6) residential apai lnuent units
("Units") within a project known as Villa Jardin II ("Project"), which is located at 122 NE 78t1'
Street Miami, Florida; and
WHEREAS, the rehabilitation will increase the supply of affordable rental housing for
Low -Income and Very Low -Income individuals and families; and
WHEREAS, on June 26, 2015, the City of Miami's Housing and Commercial Loan
Committee ("HCLC") approved an allocation of HOME Investment Partnership Program
("HOME") funds in the amount of $250,000.00 ("Loan") for Project construction hard and soft
costs; and
WHEREAS, the City and Project Sponsor entered into the Loan Agreement on February
5, 2016; and
WHEREAS, on April 26, 2019, at the request of the Project Sponsor, HCLC authorized
amending the Loan Agreement in order (i) to extend the date to obtain the Certificate of Occupancy
to June 31, 2019, and (ii) to extend the date by which the Project Sponsor must rent all Units to
Low -Income and Very Low -Income individuals and families ("Project CompletionDate") to
December 1, 2019; and
WHEREAS, except as specifically modified hereby, all terms in the Loan Agreement are
in full force and effect and all funds are subject to the same terms and conditions contained in the
Loan Agreement;
NOW,. THEREFORE, in consideration of the mutual covenants and obligations herein
set forth, the parties understand and agree as follows:
1. The Project Completion Date is extended to December 1, 2019.
2. The date by which the Project Sponsor must obtain the Certificate of Occupancy is
extended to June 31, 2019.
