RESOLUTION No. 76=1007
A RESOLUTION ACCEPTING A DONATION OF LOT 21 OF
"t,W. WHITE'S RESUB OF BLOCK 16, NORTH, CITY OF
MIAMI, PLAT BOOK B, PACE 34, FROM DADE FEDERAL
SAVINGS AND LOAN ASSOCIATION OF MIAMI, CONFIRMING
AUTHORIZATION OF THE PROPER PUBLIC OFFICIALS TO
RECORD SAID DEED IN THE PUBLIC RECORDS OF DADE
COUNTY, FLORIDA, AND AUTHORIZING THE FINANCE
DIRECTOR TO PAY THE 1976 AD VALOREM TAXES ON THE
SUBJECT PROPERTY.
WHEREAS, Dade Federal Savings and Loan Association
Miami has donated the land hereinafter described to the
City of Miami subject only to the City's paying the 1976
d valorem taxes; and
WHEREAS, the City Commission determined that it is
in the best interests of the inhabitants of the City of Miami
to accept said donation. and
WHEREAS, the proper public officials have already
recorded the deed for the subject donation in Official Records
Book 9232 at Page 931 of the Public Records of Dade County,
Florida;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA: "DOCUMENT/. IDEX
Section 1. That the donation olfrilMaof P.W.
White's Resub of Block 16, North, City of Miami, Plat Book B,
Page 34 by Dade Federal Savings and Loan Association to the
City of Miami be and the same is hereby accepted.
Section 2. That the authorization of the proper
officials to record said deed in the Public Records of Dade
County, Florida be and the same is hereby confirmed.
Section 3. That the Finance Director be and he is
authorized to pay the 1976 ad valorem taxes on the subject
property.

keference is made to the memorandum dated October 13,
1976, sett to you, which explained the background of
the donation of a certain piece of land to the City
by Dade Federal Savings & Loan Association of Miami.
(Copy of said memorandum is attached hereto.)
The Property Manager now has in hand a memorandum
from the Director of Parks & Recreation whereby his
Department and the Planning Department have surveyed
the site, and it is their recommendation that this
donation of land be accepted for development as a
passive park.
The Property Manager has spoken with Mr. Marshall Harris,
the attorney for Dade Federal Savings & Loan, and it
was their decision to donate this to the City as their
firm had no further use for the property.
Therefore, it I.:, recommended that t.11,-: law Department
be requested to prepare the necessary Resolution
accepting the donation of this property from Dade
Federal Savings & Loan Association of Miami, for de-
velopment as a mini park.

LOtli el: `Copy of Warranty Deed
the month of February 1976, the Property Management Division
received an or4inal Deed for a cettain piece of property
located at Northwest Second Avenue, between Tenth and Eleventh
Streets, Miami, Florida. This Deed was delivered to Property
Management as they are the custodians of all original Deeds,
Grants of Easements, Right -of -Jay Deeds, etc.. There were no
accompanying memoranda concerning this property - despite
efforts of the Property Management to discover the origin of
same.
Very recently it was discovered that Dade Federal Savings & Loan
Association of Miami, the Grantor of this property to the City,
through their attorney, Mr. Marshall Harris, had discussed this
matter with a former Assistant City Attorney, Mr. Tom Heaton.
Evidently Mr. Heaton was not aware that all donations to the City
must be accepted by the City Commission by Resolution, if it is
determined there is a need for this property.
During this period, the Property Manager, as Chairman c
Acquisition Committee, was given the assignment from Co
Development, to obtain appraisals for a piece of proper
approximately a block and a half away from the subject
The Property Manager, since discovering the facts surro
matter, has contacted the Director of Parks & Recreatio
evaluate the subject property, to determine if this pro
be substituted for the site selected for a mini park by
Development.
If indeed, t:his lot can be used, then a further recomme
be made to you to request the Law Department to prepare
Resolution accepting the donation of this piece of prop

10th and llth Streets

Representatives from the Planning Department arid the.
Parks and Recreation Department visited the above mentioned
Site OD October 13, 1976. Jt is located between an attorneyls
office and a. beauty parlor and is across the street from. the
Community Relations Boards Overtown Office. This area on
N. W. 2nd Avenue is commercialand scheduled_ for: a street
improvement project in the near future.
There is considerable loiteri.ng on the sidewalks and sitting
in doorways as obviously the area lacks passive seating areas
altogether. Ordinarily, finding a property of such small size
and no obvious and meaningful connection with other supportive
facilities; 1 would hesitate to recommend City involvement and
expenditure. However, I believe it is in the City's interest to
provide a passive plaza or seatin,g, area at this location.
This department met with a member of the Community Relations
Board staff - Ms. Gloria Perry. She related that the Board
and the surrounding businessmen would be interested in assisting
the City in day -today maintenance and observation of the
activities and use of the park by the area residents.
I recommend that the City accept this donation of land, develop
it as a passive seating area; perhaps using lock -block pavers,
trees of substantial height, benches, and game tables. I believe
it could be designed and developed in a low prefice manner with
little on -going maintenance cost..
