DOCIJ‘, i�� `)) i/ FCLL OVV WHEREAS, a claim has been filed by the City of Matti.' against JOSEPH C HOLLIS, MARJORIE HOLLIS, and SHELBY MUTUAL INSURANCE COMPANY, as a result of a collision between a City of Miami vehicle and an automobile owned by JOSEPH C. HOLLIS; and WHEREAS, the investigating officer at the scene of the accident found the City vehicle more than 50;; contributorily negligent; and WHEREAS, an offer of settlement on behalf of JOSEPH C. 0 HOLLIS, MARJORIE HOLLIS, and SHELBY MUTUAL INSURANCE COMPANY has been made to the City of Miami, which offer is in the amount of $170.00; and WHEREAS, the City Attorney of the City of Miami has advised that it is in the best interest of the City of Miami to accept said offer of $170.00 in full and complete settlement of the above claim; "DOCUMENT- INDEX ITEM NO. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Director of Finance is hereby authorized and directed to accept the sum of $170.00 in full and complete settlement in the claim of the City of Miami versus JOSEPH C. NOX Jr 1C CITY ATTO EY ' CITY OF MIAMI v. JOSEPH C. HOLLIS, et al. Case No. 76-3566 In the following claim a motor vehicle owned by Joseph C. Hollis, operated by Marjorie Hollis, and insured by Shelby Mutual Insurance Company, was involved in an accident with a motor vehicle owned by the City of Miami. The accident took place on July 13, 1975, at or near the intersection of southwest 12th Avenue and southwest 16th Street, Miami, Florida. Both vehicles were proceeding northwardly on southwest 12th Avenue, with the Hollis vehicle in the middle lane and the City vehicle on the inside lane. As the cars approached southwest 16th Street, the Hollis vehicle attempted to make a turn in front of the City vehicle and hit the City vehicle in the area of the right rear door and right rear quarter panel. The investigating officer at the scene of the accident found the City vehicle more than 507. contributorily negligent. Damage to the City vehicle is in the amount of $363.93. Shelby Mutual Insurance Company has offered to pay the City the sum of $170.00 in full and complete settlement of the City's claim. Based on the recommendation of Eugene M. Steinfeld, Assistant City Attorney, I recommend that the above offer be accepted in full and complete settlement of this property damage claim. GFK/E1 /bbb Resolution attached
