' CITY OF MIAMI v.
JOSEPH C. HOLLIS, et al.
Case No. 76-3566
In the following claim a motor vehicle owned by Joseph C. Hollis,
operated by Marjorie Hollis, and insured by Shelby Mutual Insurance
Company, was involved in an accident with a motor vehicle owned by
the City of Miami.
The accident took place on July 13, 1975, at or near the intersection
of southwest 12th Avenue and southwest 16th Street, Miami, Florida.
Both vehicles were proceeding northwardly on southwest 12th Avenue,
with the Hollis vehicle in the middle lane and the City vehicle on
the inside lane. As the cars approached southwest 16th Street, the
Hollis vehicle attempted to make a turn in front of the City vehicle
and hit the City vehicle in the area of the right rear door and
right rear quarter panel. The investigating officer at the scene
of the accident found the City vehicle more than 507. contributorily
negligent.
Damage to the City vehicle is in the amount of $363.93. Shelby
Mutual Insurance Company has offered to pay the City the sum of
$170.00 in full and complete settlement of the City's claim.
Based on the recommendation of Eugene M. Steinfeld, Assistant City
Attorney, I recommend that the above offer be accepted in full and
complete settlement of this property damage claim.
