GUREVITZ, FOR HIS PROFESSIONAL SERVICES, AS PROJECT ANALYST, SUBJECT TO THE TERMS AND CONDITIONS CON- TAINED IN THE ATTACHED CONTRACT; WITH FUNDS THEREFOR IN THE AMOUNT OF $1,100 HEREBY ALLOCATED FROM THE LEAA GRANT OF MONIES FOR THE THRESHOLD PROGRAM FOR PUBLIC SERVICE AIDES. T RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized and directed to enter into an agreement with ARNOLD R. GUREVITZ, for his professional services, as Project Analyst, subject to the terms and conditions contained in the contract attached hereto and made a part hereof; with funds therefor in the amount of $1,100 hereby allocated from the LEAA Grant of monies for the Threshold Program for Public Service Aides. LEAA has just extended the original grant for a period of one month from November 1 through November 30, 1976. It therefore Will be necessary to execute an additional contract with Mr. Gurevitz for this period. "SUPPORTIVE DOCUMENTS FOLLOW" 'etaber Municipal CREEMENA AGREEMENT, made and entered into this 1$th day of 19 76 , by and between the CITY OF MIAMI, corporation of the State of Florida (hereinafter re- ferred to as the "CITY") and ARNOLD R. GUREVITZ, a Projector Information Analyst for Threshold Program - Public Service Aides (hereinafter referred to as the "PROJECT ANALYST") which: both parties agree shall become effective 1 November, 1976; WITNESSETH WHEREAS, the CITY has been awarded as subgrantee, Grant o 75-AS-15-C203 from the Law Enforcement Assistance Administra- tion, United States Department of Justice for the City of Miami; WHEREAS, the City Commission, by Resolution No. 75-953, passed and adopted on October 9, 1975, has accepted this grant and authorized and directed the City Manager to execute con- tracts and agreements in connection therewith; and WHEREAS, pursuant to the Grant the PROJECT ANALYST has agreed to provide the following professional service and work product in cooperation with the Police Department of the City of Miami; NOW, THEREFORE, in consideration of the mutual covenants and agreements hereinafter set forth, and for and in considera- tion of ONE DOLLAR ($1.00), receipt of which is hereby acknowl- edged, and other valuable consideration, the parties hereto covenant and agree as follows: 1. Devise instrumentation to determine the eked Stet objectives as depicted in the Grant. ?. Assist in the Completing of the quarterly and final Enforcement Assistance Administration evaluation for the ject, based on accumulated data. C. Perform comparison analyses, utilizing the tine for stribution of calls for service histogram. O. Document the number of Public Service Aides recruited o full-time law enforcement. E. Compute and record the number of hours that full-time police officers are released from routine duties and calls due tb Public Service Aides activity. F. Measure the effectiveness of Public Service Aides - development as related to reducing response time, and overall rnpact or G. Public H. assignments as they may affect the total crime picture. Design and prepare charts and activity maps pertaining Service Aide activity. Development and coordination of procedures for provid- ing assistance to project staff, consultants, and departmental members regarding Public Service Aide activity. I. Maintain data sufficient to provide project staff with a perpetual evaluation. 2. The compensation to be paid to the PROJECT ANALYST shall e a total of one thousand one hundred dollars ($1,100.00) for the duration of this Agreement, as herein set forth, payable in equal installments of five hundred and fifty dollars ($550.00) on the 15 November 1976 and 1 December 1976 as consideration for the professional services and work product of the PROJECT ANALYST. Said amount shall constitute full compensation for the PROJECT ANALYST for the professional services and work product specified herein. The professional serUioes and work product to be rendered and performed by the PROJECT ANALYST shall be rendered and performed to the reasonable satisfaction of the Chief of Police of the CITY and the duty of the CITY to pay the compensa- tion to the PROJECT ANALYST provided in Paragraph 2 of this Agreement shall be subject to such satisfactory performance. The PROJECT ANALYST recognizes that the source of the funds is the above identified Grant awarded to the CITY. The PROJECT ANALYST therefore agrees that the duty of the CITY to pay all Or any part of the compensation to which the PROJECT ANALYST will or may be entitled pursuant to this Agreement, shall be contingent on the receipt by the CITY of Grant funds in an amount or amounts at least equal to the amount or amounts of compensation due hereunder. 4. The PROJECT ANALYST shall be deemed to be an indepen- dent contractor. No agent or employee of the PROJECT ANALYST who may render, directly or indirectly, any service pursuant to or in connection with the performance of the PROJECT ANALYST's obligations pursuant to this Agreement, shall in any event or circumstance be deemed to be an agent or employee of the CITY, and no such person shall be entitled to any right or benefit to which CITY employees, whether classified or un- classified, are or may be entitled by reason of their employ- ment by the CITY. 5. The City Manager shall have the right, upon ten (10) days written notice to the PROJECT ANALYST, to terminate this •Agreement if the PROJECT ANALYST shall fail to perform his obligations hereunder to the reasonable satisfaction of the Chief of Police of the CITY, or if he shall otherwise fail to perform an obligation or fail to render any performance expressly or impliedly required by this Agreement. In the event that the City Manager terminates this Agreement, as above �. 3 , EN.T S FOL LOVV dcd, all cloctiments, data, studies, reports or other itten material prepared by the PROJECT ANALYST in connectiO ith this Agreement, shall at the option of the CITY become the property of the CITY; and the PROJECT ANALYST shall, in such event, be entitled to receive just and equitable compensation for the services he shall theretofore have rendered. 6. This Agreement may be terminated by mutual agreement the parties upon such terms as may be agreed upon, provided that if this Agreement is terminated prior to the completion of the PROJECT ANALYST's services as contemplated by this Agree- ment, the aggregate compensation to which he may be entitled shall not exceed an amount which bears the same ratio to the total compensation provided by this Agreement to be paid, as the services actually performed by the PROJECT ANALYST bear to the aggregate of the services contemplated to be rendered by the PROJECT ANALYST by this Agreement. 7. The PROJECT ANALYST covenants that he presently has no interest and shall not acquire any interest, direct or in- direct, which would conflict in any manner or degree with the performance of the services required to be performed under this Agreement. The PROJECT ANALYST further covenants that in the performance of this Agreement, no person having any such con- flicting interest shall be employed by him. 8. No report, information, data, etc., given or prepared or assembled by the PROJECT ANALYST under this Agreement, including both raw or source data, as well as evaluation there- of, shall be made available to any individual or organization by the PROJECT ANALYST without prior written approval of the City Manager. 9. No material produced in whole or in part under this Agreement shall be subject to copyright in the United States, or in any other country. The CITY shall have unrestricted authority to publish, disclose, distribute and otherwise use, ble Ot in part i at y tepdtts, data er other Materials ►,pared under this Agreement. All of the said material shall ledoMe the property of the CITY and the PROJECT ANALYST shall have no claim of any nature whatsoever upon the work papers, work product, and other work material so surrendered to the CITY. 10. The PROJECT ANALYST shall be obligated to supervise and assist, insofar as practicable and necessary in order to accomplish the purposes of the above mentioned Grant, all CITY personnel and all other persons participating in the project. In carrying out his duties and responsibilities, the PROJECT ANALYST will render the Project Manager such assistance as may be desirable and necessary in assuring the accomplishment of the purposes and goals of the Grant. 11. This Agreementshall not be altered or amended except by written instrument executed by both parties. IN WITNESS WHEREOF, the parties hereto have caused this instrument and exact duplicates hereof to be executed in their names by the persons thereto legally qualified.
