WHEREAS, the City of Miami estimates that the non-exempt
a39regate valuation of taxable property, both real and personal, in the City -

September 30, 1977, is 53,78?,137,8+6; and
'rJHEREAS, at ,n election held Septe,:.ber 2, 1925, the City of
~1iami did a~rnex certain territory unincorporated at the time of sucn election,
and did ar.n~x certain other territory incorporated at the tine of such elec-
tion, and fl-om time to tine other territor;: has been included in the Ci ty
lir7iis of the City of tiizmi by legislative acts;

Amendment to the Constitution of the State of Florida,
and subject to the terms thereof.
These millages total 11.903 mills.
Section 3. If any. section, part of section, paragraph or clause
of this ordinance shall be held to be unconstitutional or void, the remaining
provisions of this ordinance shall, nevertheless, remain in full force and effect.

e~~eiiditure requirements for the City but are not r.3ndatory should efficient
administration of City Departments and Boards or altered economic conditions
indicate that a curtailment in certain expenditures is necessary or desirable
fdr general welfare of the City. The City h'ar.ager is specifically authorized
• to transfer funds between accounts and withhold any of these appropriated
funds from encumbrance or expenditure should such action appear advantageous
to the economic and efficient operation of the City. .
Section 6. The City Manager is authorized to administer the
executive pay plan and t9 disburse the funds allocated in this budget for
this purpose in a manner he deems appropriate, with the exception of those
positions in which the salary is established by Ce-r,~ission or Board Action.
The City P~ianager is further authorized to establish the salary of those
employees in the executive and staff positions in accordance with the execu-
tive and staff pay plan. These employees are en*_i~led to any salary increases
given in Section 7.
Section 7. The City Manager is out^orized to disburse any funds
that may be designated by the City Commission as cyst-of-living or other pay
''adjustments to Civil Service, executive and staff e~~~ployees as may be approved
by the City Corr~nission.
Section 8. Nothing contained in this ordinance shall be con-
strued as to prohibit or prevent the City i'anager, the administrative head of
the City of Miami, who is respcnsible for tha efficient ad~inistration of all
pepartm~nts, from exercising the p~•.v~r granted to end inpos~d upon hi~^ in the
City Charter to fix, adjust, raise, or lo,~er s~l.r'es, and to create, abolish,
fil] or hold vacant, temporary or per-r'anent pc~itc,;; a;henever it has been
ddtprmi-;ed by the City t•iar,ager to be in ti,a host ice,=_rest of efficient, and
econo^~ic.al adr;inistration of the City of i•;ia-,i zrd all its D:~partTents. The

transfer between any of the amounts appropriated by the above sections. In

rents, the City hianager is further authorized to make departmental and other {
transfers from and into the Reserve Employee Adjustments Account of Special
Programs and Accounts, or such other reserve accounts established therein by _
the City Manager or City Comrc~issior~, in the General Fund and is authorized to
approve transfers of Intragovernmental Service Funds and Public Facilities ,F
Funds as may be required, The Contingent Fund is hereby declared to be appro-

priated, and subject to expenditure by the City Manager for any emergency
purpose. Except as herein provided, transfers between items appropriated ''
hereby shall be authroized by ordinances amendatory hereto, except that __
transfers from the Contingent Fund may be made by Resolution.
Section 10. The City hianager is directed to prepare and file
with the City Clerk a statement of the proposed expenditures and estimated
revenues for the fiscal year 1976-77, which shall be entitled "Ann'J31 B~:d^yet ..
ofthe City of tdiami, fiscal year October 1, 1976, through September 30, 1977."
Section 11. The City hianager is hereby authorized to invite
or advertise for bids for the purchase of any material, equipment, or service

embraced in the aforementioned appropriations or which may be provided for }

in accordance with the authority of Section 10, for which formal bidding is
required; such bids to be returnable to the City Co;r:mission or City i~lanag~r
in accordance ~•~ith Charter or Code provisions. ~`
Section 12. If any section, part of section paragraph, clause, ~,

phrzse, or ~•~ork of this ordinance is declared invalid, the remaining provisions

of t-~ ordinance shall nor be affected. {
Section 13. All ordirances or parts of ordinances, ir,sofar`as
they are inconsistent or in conflict trth the provisions of this ordinance,
are hereby repzaled.
