Orange Bowl Bpecial obligation Bond. Ordinance, mandates, with
respect to charges other than flat -rate charges that the
"charges based on a percentage of admission price to be paid
by the sponsor of any event in the Orange Bowl shall be that
percentage as shall be fi>ed from time to time by the city Com-
mission but not less than ten percentum (10%) nor more than
fifteen percentum (15%) of the gross admission price derived
by such sponsor for such event, less any federal, state or
locally imposedtax payable from such admission price..."; and
WHEREAS, the City maintains and funds a Department of
Publicity and Tourism for the purpose of attracting numbers of
tourists and visitors from places other than the South Florida
Area because of the importance of the presence of such persons
to the local economy;, and
WHEREAS, the National Football League (NFL), through
its "Super Bowl", "American Conference Championship" and "Playoff"
games focuses national and international attention and publicity
on the City in which such games are played; and
WHEREAS, the City Commission finds that the economic
impact of certain special events including NFL post -season games
has great economic significance for the ;.ity because of the attend-
ance at such events of large numbers of patrons from places other
than the Greater Miami Area; and
WHEREAS,' in order to attract such special events the City
Commission finds that flat -rate charges should be negotiated with
the sponsor of such special events including the NFL on such terms
as may be in the best interest of the City

(a) Definitions: Asused herein:
(1) The term "sponsor" means the person
or parties entering into a use agreement with the
city for an event or series of events to be held.
in the Orange. Bowl Memorial Stadium
and may also bereferred to as 'user".
(2) The term "stadium" means Orange
Bowl Memorial Stadium.
(3) The, term "patron" means the person
purchasing an admission ticket, to an event or
series of events in said stadium aswell as the
person seeking entry to an event.',
(4) i. The. term "athletic event" means
an activity or gathering involving
sport contests or games such as
boxing, football or soccer;
ii. The term "non -athletic event" means
an activity or gathering other than
an athletic event, such as carnivals,
circuses, concerts and religious or
political conventions. The examples
herein are illustrative only and do
not preclude other types of activities
or gatherings.
iii, The term "event" means both athletic
events and non -athletic events as herein
defined.
(b) Admission tax and rthi itM dhar'c esi
(1) except as otherWise provided in this
Section,there shan be levied oh eaoh adrissiah
to the stadium a city tax of 15% Of the groat price,
asestablished by the sponsor, of each aclt fission
ticket sold by the sponsor of the event to be held
in the stadium, less any federal, state or locally
imposed taX.payable from such admission pride.
(2) Such taR amount shall be separately
shown and printed upon each ticket. The above tax
amount shall apply to and be paid by the sponsor
upon all tickets sold for admission, to the stadium,
whether or not such tickets are used, and shall apply
to and be paid by the sponsor upon all complimentary
tickets or passes not otherwise exempted hereunder.
If the sponsor has established no gross price for
admission on a complimentary ticket orpass, the gross
price on each such complimentary ticket or pass is
hereby established as that amount as established by
the sponsor which is required to be paid by a patron
for admission to the event.
(3) The sponsor shall keep available in its
office or such other place approvedby the city man-
ager of the city, true, accurate and complete records
and accounts of all ticket sales transacted in connec-
tion with the stadium event and shall give access to
the authorized representatives of the city, dur-
ing reasonable business hours, to examine and
audit such records and accounts. Final account-
ing'and payment of all sums due hereunder shall be
made to the proper city authorities as soon
after the holding of each event as may be
reasonably possible, and in no case shall be
permitted to remain unpaid longer than three
wor)G-ng days after the event, and in all cases
shall be paid prior to the holding of
anothet sUbsec1lieht event by the same sponsors
(4) The sponsor Of any event at the stadium'
and the Seller of the tickets shall be respoheible
for the Collection -and payment of`all .teR monies
required to, be collected hereunder and shall
hold in trust for the City all amounts dire here-
under and shall account for and pay overto the
city all such sums within the periods required,
or immediately upon, written demand by the
director of finance of the city; failure to
make full accounting and payment upon, demand
shall subject the sponsor to a penalty of 2%
per month or fraction thereof intervening
between such demand and final accounting and
payment, exclusive of the first 24:hours of
suchperiod, which penalty shall be additional
to other penalties provided by this Code and
the City Charter.
(5) The tax levied hereby and all sums
paid to the city under this Section shall be
deposited by the city daily as received in the
funds and accounts of the stadium, and reserved
therein and disbursed therefrom solely for the
operation, maintenance, improvement and debt
service of the stadium,
(6) If the total sum of the tart monies
collected hereunder is less than the cost

(d) Spedial Charges, Terms and conditions.
(1) The charge for the use of the stadium
by the NFL for any of its post -Season games shall
be determined by the City.Commission.
(2) The sponsor of any event shall obtain
at its sole cost and expense public liability_
insurance in amounts of not less than $1,000,000
per occurrence for bodily injury and $100,000 per
occurrence for property damage and the city shall
be one of the named insureds in said policy. A
certificate of such insurance shall be provided
tothe city at least 10 days before the date of
the scheduled event.
(3) The sponsor of any event shall
indemnify and save harmless the city against
any and all claims, suits, actions, damages,
or causesof actions for any personal injury,
loss of life or damage to property sustained
by reason of or as a result of the sponsor's
use of the stadium and. from and against any
orders, judgments or decrees which may be
entered thereon, and from and against all
costs, attorneys' fees, expenses and
liabilities incurred in the defense of any
such claim and the investigation thereof.
(4) At any time when a flat -rate charge
is imposed for the use of the stadium to stage
any event or when admission and entry to any
eVdht . is hot dohditioned upOh the pUtdhase
Of a ticket or the paymmeht of a fee by the
patron, the chargeto the sponsor for the use
Of the stadium shall include and shall be hot
less than the cost of operating the stadium for
said event, said cost also being referred to,,
herein as the "stadium service fee"
(5) The city shall provide the number
of uniformed police officers and the number of
security personnel for security and etraordinary
crowd control within the stadium and in the
immediate area outside the stadium, as determined
necessary by the city, with payment of the cost
therefor to be made by the sponsor to the city. The
cost of the aforesaid security servicetogether with
the cost of all other event personnel, utilities,
stadium clean-up and stadium maintenance comprises
the stadium service fee and will be paid to the
city by the sponsor of any event held in the stadium.
Due payment to the city of the entire flat -rate
charge, if such be imposed, or all tax monies, as
set forth in subsection (b) hereof, will constitute
payment of the stadium service fee.
(6) In every athletic event, sponsor.
shall furnish all admission tickets in addition
to the following personnel: ticket takers, ticket
sellers and ushers in sufficient numbers as the
city determines necessary to handle seating and
ordinary crowd control.
(7) Nothing contained in the provisions of
this Section shall limit or restrict the right of
the City Commission to establish and fix special
charges or special terms and conditions for the use
of the stadium.'

'on two separate days is hereby dispensed with by a four -fifths;.
vote of the members of the, Commission.
