RESOLUTION NO6 76428
A RESOLUTION DEFERRING COLLECTION OF THE
ASSESSMENTS ON CERTAIN PROPERTIES INCLUDED
IN THE SIMPSON SANITARY SEWER IMPROVEMENT
DISTRICT SR-5391-C UNTIL JULY 1, 1980,
OR UNTIL THE SAID PROPERTIES ARE TAKEN IN
CONDEMNATION FOR RAPID TRANSIT PURPOSES OR
CONVEYED TO A GOVERNMENTAL AGENCY IN LIEU
OF CONDEMNATION, WHICHEVER IS FIRST, FURTHER
PROVIDING THAT IF SAID PROPERTIES ARE TAKEN
IN CONDEMNATION FOR TRANSIT PURPOSES OR CON-
VEYED TO A GOVERNMENTAL AGENCY IN LIEU OF
CONDEMNATION PRIOR TO JULY 1, 1980, THE LIENS
SHALL BE CANCELLED BY THE CITY COMMISSION.
WHEREAS, on September 4, 1975 the Commission by
Resolution No. 75-785 ordered the Simpson Sanitary Sewer
Improvement SR-5391-C (Centerline sewer); and
WHEREAS, on October 9, 1975 the Commission by
Resolution No. 75-919, after duly advertised public hearing,
confirmed ordering Resolution No. 75-785 which ordered the
Simpson Sanitary Sewer Improvement SR-5391-C (centerline sewer); and
WHEREAS, on July 1, 1976 the owners of certain
properties included in this improvement district appeared at
the Commission meeting objecting to the construction and assessment
of the said Simpson Sanitary Sewer Improvement because Dade
County intended to purchase or condemn their property for the
rapid transit system at some future date; and
WHEREAS, on July 1, 1976 the Commission passed
Motion No. 76-655 to defer assessment of certain properties in
the Simpson Sanitary Sewer Improvement District SR-5391-C
(centerline sewer) until July 1, 1980;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the collection of the assessments
on the following described property:

(centerline sewer) be, and it is hereby deferred until July 1,
1980, or until the said properties or any of them be taken in
condemnation for rapid transit purposes or public parking related
to rapid transit, or conveyed to a governmental agency in lieu
of condemnation, whichever is first.
Section 2. If one or more of said properties be taken
in condemnation for transit purposes or public parking related
to rapid transit, or conveyed to a governmental agency in lieu
of condemnation, prior to July 1, 1980, the liens shall be
cancelled by the City Commission in respect of each property
so taken or conveyed.
PASSED AND ADOPTED this 14TH day of OCTOBER
1976.

Resolution deferring c011ection of
assessments on certain properties
,inCluded in the Simpson Sanitary
Sewer Improvement bistrict
On July 1st, 1976, the owners of certain property included
in the Simpson Sanitary Sewer Improvement District appeared
before the City Commission requesting that assessments be
deferred on their property because Dade County intended to
purchase or condemn their property for the rapid transit
system.
The City Commission made a motion to defer the collection of
said assessments and the Director of Public Works, the City
Attorney's Office, and Mr. David Parrish, one of the property
owners, met and agreed on the wording of a Resolution. Said
Resolution is attached hereto.
Mr. Parrish has requested that he be notified of the date and
time that this matter will be heard so that he may be present
at the Commission Meeting.
