A RESOLUTION AUTHORIZING THE DIRECTOR
OE FINANCE TO ACCEPT THE SUM OF S250.00
IN FULL AND COMPLETE SETTLEMENT IN THE
CLAIM OF THE CITY OF MIAMI VERSUS PLUST
ENTERPRISES, INC., AND MERIT INSURANCE
COMPANY; AND AUTHORIZING THE CITY MANAGER
AND THE CITY CLERK OF THE CITY OF MIAMI
TO EXECUTE A RELEASE RELEASING PLUST
ENTERPRISES, INC., AND MERIT INSURANCE
COMPANY FROM ANY AND ALL CLAIMS AND
DEMANDS ARISING OUT OF THE ACCIDENT
INVOLVED IN THE ABOVE CLAIM.
WHEREAS, a claim has been filed by the City of Miami
1st plustEnterprises, Inc., and Merit Insurance Company, as
result of a collision between a City of Miami vehicle and an
automobile owned by Plust Enterprises, Inc.; and
WHEREAS, an offer of settlement on behalf of Plust
dnterprises, Inc. and Merit Insurance Company has been made to
he City of Miami, which offer is in the amount of $250.00; and
WHEREAS, the City Attorney of the City of Miami has
dvised that it is in the best interest of the City of Miami to
accept said offer of $250.00 in full and complete settlement of
the above claim;
NOW, THEREFORE, BF IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORDIA:
Section 1. The Director of Finance is hereby
authorized and directed to accept the sum of $250.00 in full and
complete settlement in the claim of the City of Miami versus Plust
Enterprises, Inc. and Merit Insurance Company, and the City Manager
and the City Clerk of the City of Miami are authorized to execute
a release releasing Plust Enterprises, Inc. and Merit Insurance
Company from any and all claims and demands arising out of the
accident involved in the above claim.

Enterprises, Inc. et al
lti the following claim, a motor vehicle owed by Plust Enterprises,
Inc. and insured by Merit Insurance Company, was involved in an
accident with a motor vehicle owned by the City of Miami. The
accident occurred on February 3, 1976, at Northwest 95th Street
and N.W. 12th Avenue, Miami, Florida
The Citv vehicle was proceeding eastbound on N.W. 95th Street.
The other vehicle was proceeding eastbound in the inside lane and
attempted to make a right turn in front of the City vehicle
into a private drive, striking the City vehicle. The other vehicle
completed the turn and proceeded up the private drive. It was
finally ove= _- r, at 3Y3O N.:' l' `' Court.
Damages to r.h` Cite vehicle amounted to S287.70. Costs advanced
amounted to S30.00.
Merit Insurance Company has offered to pay the City $250.00 in
full and complete settlement of all claims.
Based on the facts of this case, I recommend that the above offer
be accepted in full and complete settlement of this property damage
claim.
