Schwartz, :Circuit Judge, and WHEREAS, this claim has been investigated by the office the city Attorney and said office recommends that this claim settled for the sum of $791.00, and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the Director of Finance be and he is hereby authorized to pay to JAMES BRANCH, without the admission f liability, the sum of $791.00 in full and complete settlement f all claims and demands against the City of Miami, upon the execution of a release releasing the City of Miami from all claims and demands. The following claim has been made against the City of Miami: BRANCH, Ruby Lee vs. City of MiaMi VC-76-158 Ruby Lee & James Branch were arrested by the City of Miami Police Department. Upon their arrost their property was taken from them con- sisting of $791.00 in U,S..currenCy. Said property was placed in the Miami Police Department.Pfbporty Room.. On September 16, 1976, Circuit Court Judge Alan R. Schwartz, ordered the City of Miami Police Department to return the above mentioned property to Mr. JFimes 'Branch. When Mr. Branch requested his property from the Miami Police.,, Department's Property Unit, he was advised that said property was Missing. After a thorough investigation of this matter, it has been determined that this is one of a series of cases where items :have been missing from the Property Unit of the Miami Police Department. Based on the recommendation of Mr. Mario Santana, Legal In- vestigator, I recommend that the above claim be settled for the amount claimed by the claimatit and verified by the Miami police Department in the sum of $791.00. . .
