HomeMy WebLinkAboutR-76-0924Mg/&eb i0/12/76 -gOttTiON NO. _.„76Lg24 ESOLUTION AUTHORIZING THE DIRECTOR OP MANCE TO PAY TO MARIE BUSH, WITHOUT ADMISSION OF LIABILITY, THE SUM OF $1000,00 • IN'FULL AND COMPLETE SETTLEMENT OF ALL CLAIMS ANID DEMANDS AGAINST THE CITY OF MIAMI, UPON -THE EXECUTION OF A RELEASE RELEASING THE -CITY OF MIAMI FROM ALL CLAIMS AND DEMANDS, nEREAS, MARIE BUSH, filed a claim against the City iti for alleged personal injury resulting from an Ctident involving a City owned sidewalk on April 18, 1975i Aocated at 60 N.E. 50th St., Miami, Florida and, WHEREAS, the above claim has been investigated by the' Torts Division of the City Attorney's Office and said office recommends that this claim be settled for the sum of $1000.00, .and, NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the Director of Finance be and he is hereby authorized to pay to MARIE BUSH, without the admission ''•of liability, the sum of $1000.00 in full and complete settle- nent of all claims and demands against the City of Miami, upon the execution of release releasing the City of Miami from all claims and demands. Weston Acting City Attorney PE.Fr.RENCc.S1 marie Bush vs City of Miati ENcLosuncs: Resolution Marie Bush has filed a claim against the City of Miarni in the sum of $2000,00, which included $891.94 for out of pocket eX- penses for medical drugs etc. Mrs. Bush claimed that she tripped over a broken sidewalk located ift front of 60 Northeast 50th Street, Miami, Florida on April 18, 1976. The Torts Division of the Law Department has investigated this tlaim thoroughly and found that the above mentioned sidewalk is owned and maintained by the City of Miami and said sidewalk was broken at the time of this alleged fall. The sidewalk was repaired by the City of Miami Public Works Department after this alleged fall. Three (3) witnesses were found at the accident side location veri- fying the claimant's story as to the cause of her fall and the in- jury involved. After negotiations and on the recommendation of Mr. Mario Santana, Legal Investigator, the claimant on the above claim has agreed to settle in full for the amount of $1000.00. It is my recommendation that this case be settled for the above amount of $1000.00. FHW/MS/aeb Enclosure ( Resolution )
