WHEREAS, the City Commission adopted ResOlutio;l 647, passed and adopted October 15, 1.968, authorizing Concession agreement with PHILLIPS PETROLEUM COMPANY for the purpose of constructing and operating a Marino Refueling Facility at Watson Island, for a term of 5 years beginning July 14, 1971 and ending July 13, 1976, with an additional 2 year optior upon application for the extension at least 30 days prior to the ' t 5 pi ration ^- �;A year period; and WHEREAS, Resolution No. 42311, passed and adopted arch 11, 1971, authorized an Addendum dated July 19, 1973 to allow sale of accessory items not related to petroleum or its products, and to require payment in the amount of 7% of the gross sales of said accessory items, as described in Schedule "A" as attached to Addendum; and WHEREAS, Resolution No. 72-638, passed and adopted October 12, 1972, authorized an Addendum dated July 19, 1973, to 110w the sale of beer; and WHEREAS, the concessionaire, PHILLIPS PETROLEUM COMPANY, filed to make application for the extension of 2 year option at least 30 days prior to the expirgtipi4 9 V[:W o e ,aid 5 year period; and WHEREAS, this concession has been �o i ?r t.= '. by sub - ant.• BEP'i TVMP SON, d/b/a BETTE AND PERT BAVF RONT 66 MARINA INC,, 4 save represented PHILLIPS PETROLEUM COMPANY over the past ar$, arKi 4 sa3t __factory i:trr:tngment h'ls been ('t_uie with th? The City Manager is hereby authorized and ctcd to henceforth permit BERT TUMPSON, d/b/a BETTE AND BERT II WFRONT 66 MARINA INC. to operate the Marine Refueling Facility Concession at Watson Island on a monthly basis, subject to the same terms and conditions which prevailed between the former concessionaire PHILLIPS PETROLEUM COAPANY, and the City of Miami until July 13, 1976, which terms and conditions have been assured by the said BERT TUMPSON individually and as a representative of BETTE AND BERT 66 MARINA INC. Section 2. The action of the City Manager in allowing BERT TUMPSON, d/b/a BETTE AND BERT 66 MARINA INC. to operate the aforesaid facility concession since the termination of the prior concession agreement on July 13, 1976 is hereby ratified and approved. 1976, ATTEST: PASSED AND ADOPTED this 14 day of OCTOBER (52 Y C! Gtassie City Manager i Clifton ce Hays Assistant City Mandget I.) fljt:I: ON-5 WS Watson Island Refueling facility tktension of Leate rest-ot,ices tk•CLoSUR 17S; tiLt: The existing concession agreement with Phillips PetrdleUM CoMpany for the operation of a marine refueling facility at Watson Island expired on July 13, 1976. The redevelopment of Watson Island is now in the planning stage with various improvements planned to be constructed in the near future. The Watson Island Marina is not to be included in the redevlopment plan; threfore, the City does not want to enter into a concession agreement for a definite term for the operation of this marine refueling facility. The tenants at the Watson Island Marina have been allowed to rent space on a month -to -month basis until it is necessary that they vacate. Phillips Petroleum has agreed to continue operating the refueling facility on the same basis with a 60-day mutual termination notice provision. So that this service will not be disrupted while the Watson Island Marina continues to be used, it is recommended that City Commission authorization be given, permitting Bert Tumpson, d/b/a Bette and Bert Bayfront 66 Marina, Inc. to continue to continue to operate the marine refueling facility concession at Watson Island on a Month -to -month basis.
