HomeMy WebLinkAboutR-76-0866Rt'C/rb 10/5/76 RESOLUTION NO. 7C-365 A RESOLUTION CERTIFYING AND DECLARING THE FOLLOWING RESULTS OF THE SPECIAL BOND ELECTION HELD SEPTEM- BER 28, 1976: WITH RESPECT TO BOND QUESTION NO. 1, ISSUANCE OF $25,000,000 BONDS FOR PAYMENT OF THE COST OF IMPROVEMENTS AND EXTENSIONS FOR THE SANITARY SEWER SYSTEM OF THE CITY OF MIAMI, APPROVED; WITH RESPECT TO BOND QUESTION NO. 2, ISSUANCE OF $10,000,000 FOR PAYMENT OF THE COSTS OF FIRE FIGHTING, FIRE PREVEN- TION AND RESCUE FACILITIES, APPROVED; WITIi RESPECT TO BOND QUESTION NO. 3, ISSUANCE OF $10,000,000 FOR PAY- MENT OF COSTS OF STREET LIGHTING FACILITIES IN THE CITY OF MIAMI, DISAPPROVED; FURTHER AUTHORIZING AND DIRECTING THE PROPER CITY OFFICERS TO PERFORM ANY AND ALL INCIDENTAL DUTIES AND TO TAKE APPROPRIATE PRO- CEEDINGS IN CONNECTION WITH THE ISSUANCE OF SAID SANITARY SEWER BONDS AND FIRE FIGHTING BONDS, AS REQUIRED BY LAW. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The returns of the special bond election held on September 28, 1976 having been received from the election offi- cials of each of the voting precincts within the City of Miami and the Commission having duly canvassed such returns hereby declares: (a) Said election was duly and properly held and notice thereof was duly given in accordance with law and Ordinance No. 8574 passed and adopted Ju1.y 22, 1976 entitled: "AN ORDINANCE PROVIDING FOR THE HOLDING OF A SPECIAL BOND ELECTION IN THE CITY OF MIAMI, FLORIDA, ON SEPTEMBER 28, 1976; DECLARING THIS ORDINANCE TO BE AN EMERGENCY MEASURE, AND PROVIDING THAT THIS ORDINANCE SHALL GO INTO EFFECT IMMEDIATELY UPON ITS PASSAGE, AND DISPENSING WITH THE READING OF THIS ORDINANCE ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE COMMISSION." (b) A11 steps in connection with the leading up to said special bond election were duly, regularly and lawfully taken and had; and all applicable provisions of the Constitution and Stat- utes of the State of Florida and of said Ordinance have been fully complied with. (c) The inspectors and clerks of each election precinct in the City have duly made returns to the Commission of the results of the election in each such precinct on the questions submitted at said election. (d) At said election there were submitted to the qualified electors of the City of Miami, Florida, the following questions: BOND QUESTION NO. I Shall bonds of the City of Miami, Florida, in an aggregate principal amount not exceeding $25,000,000 be issued under the provisions of Ordinance No. 8573 for the purpose of paying the cost of IMPROVEMENTS AND EXTENSIONS OF THE SANITARY SEWER SYSTEM of the City of Miami, such bonds to be issued at one time or from time Lo Lime and to mature in annual installments 2 to 20 years, inclusive, after the date of the respective bonds, to bear interest at a rate or rates not exceeding the rate legally permitted, and to be payable from unlimited ad valorem taxes, which may be reduced in any year to the extent that moneys are then held for such payment from special assessments, if any, are levied on account of such improvements? BOND QUESTION NO. 2 Shall bonds of the City of Miami, Florida, in an aggregrate principal amount not exceeding $10,000,000 be issued under the provisions of Ordinance No. 8571 for the purpose of paying the costs of FIRE FIGIHTING, FIRE PREVENTION AND RESCUE FACILITIES, such bonds to be issued at one time or from time to time and to mature in annual installments 2 to 20 years, inclusive, after the date of the respective bonds, to bear interest at a rate or rates not exceeding the rate legally permitted, and to be payable from unlimited ad valorem taxes? BOND QUESTION NO. 3 Shall bonds of the City of Miami, Florida, in an aggregate principal amount not exceeding $10,000,000 be issued under the provisions of Ordinance No. 8572 for the purpose of paying the cost of STREET LIGHTING FACILITIES in the City of Miami, such bonds to be issued at one time or from time to time and to mature in annual installments 2 to 20 years, inclusive, after the date of the respective bonds, to bear interest at a rate or rates not exceeding the rate legally permitted, and to be payable from unlimited ad valorem taxes? (e) Each qualified elector of the City of Miami was given the opportunity of voting for or against the issuance of said bonds. Section 2. (a) With respect to Bond Question No. 1, it is hereby found and determined that 8,606 votes ;were cast by qualified electors in favor of the issuance of said bonds; that 6,556 votes were cast by qualified electors against the issuance of said bonds; that the Commission hereby declares and certifies that the issuance of said $25,000,000 sanitary sewer bonds of the City of Miami was approved by the qualified electors of the city of Miami at said special bond election; that the total number of ballots cast at said special bond election in the 87 voting precincts was 23,585; and that a majority of the votes cast in said bond -2- e .odtion were in favor of approving the issuance of said bonds. (b) With respect to Bond Question No. 2, it is hereby found and determined that 7,967 votes were cast by qualified electors in favor of the issuance of said bonds; that 7,096 votes were cast by qualified electors against that the Commission of said $10,000,000 hereby declares and fire fighting bonds the issuance of said bonds; certifies that the issuance of the City of Miami and approved by the qualified electors of the City of Miami at said special bond election; that the total number of ballots cast at said special bond election in the 87 voting precincts was 23,585; and that a majority of the votes cast in said bond election were in favor of approving the issuance of said bonds. (c) With respect to Bond Question No. 3, it is hereby found and determined that 7,179 votes were cast by qualified electors in favor of the issuance of said bonds; that 7,847 votes were cast by qualified electors against the issuance of said bonds; that the Commission hereby declares and certifies that the issuance of said $10,000,000 street lighting bonds of the City of .Miami was disapproved by the qualified electors of the City of Miami at said special bond election; that the total number of ballots cast at said special bond election in the 87 voting pre- cincts was 23,585; and that a majority of the votes cast in said bond election were against the approving of the issuance of said bonds. Section 3. The proper officers of the City of Miami are hereby authorized and directed to perform any and all inciden- tal duties and to take appropriate proceedings in connection here- with as required by law for the issuance of the aforesaid sanitary sewer bonds and fire fighting bonds.
