HomeMy WebLinkAboutItem #08 - First Reading OrdinanceORDINANCE NO. 111 I III�IAfllll IlI II AN ORDINANCE MAKING APPROPRIATIONS OF FEDERAL REVENUE SHARING FUNDS IN THE AMOUNT OF S15,707,000, FOR THE FISCAL YEAR ENDING SEPTE;•'BER 30, 1977, SUCH FUNDS COMPRISED AS FOLLOWS: FUNDS IN THE AMOUNT OF $8,807,000 TO BE RECEIVED DURING 1976-77 BUDGET YEAR AND $6,900,000 OF EQUITY FUNDS; PROVIDING THAT IF ANY SECTION, CLAUSE, OR SUBSECTITJN SHALL BE DE- CLARED UNCONSTITUTIONAL, IT SHALL NOT AFFECT THE REMAINING PROVISIONS, REPEALING ALL ORDINANCES, OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, DECLARTN8 THI-S ORDINANCE TO BE AN EMERGENCY MEASURE AND BY A FOUR -FIFTHS VOTE OF THE MEMBERS OF THE CITY COMMIS- SION, DISPENSING WITH THE REQUIREMENT OF READING THIS ORDINANCE ON TWO SEPARATE DAYS. WHEREAS, the City Manager has prepared and submitted to the City Commission a Plan for Expenditure of Federal Revenue Sharing Funds for the fiscal year 1976-77, copies of the plan having been advertised as required under the provisions of the Fiscal Assistance to State and Local Governments Act (PL 92-512); and WHEREAS, provisions have been duly made by the City Commission for Public Hearings on the proposed plan before the City Commission as a Com- mittee of the Whole and Public Hearings thereon were held; and WHEREAS, the City Commission has reviewed and amended the City Manager's Plan for the Expenditure of Federal Revenue Sharing Funds and has approved appropriations as herein set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following appropriations are made from the Federal Revenue Sharing Funds for the purposes outlined below for the Fiscal Year 1976-77: Municipal Services 1. Extension of Recreation Program 2. If any Section, part of Section paragraph, clause, phrase, or work of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 3. All ordinances or parts of ordinances, insofar as they are inconsistent or in conflict with the provisions of this ordinance, are hereby repealed. Section 4. This ordinance is hereby declared to be an emergency measure on the ground of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further ground of necessity to make the required and necessary payments to its employees and officers, payment of its contracts, payment of interest, and principal on its debt, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of its municipal affairs. Section 5. The requirement of reading this ordinance on two separate days is hereby dispensed with by a four -fifths vote of the members of the Commission. In recognition of the importance of full program funding, the City shall provide partial tundinq only in cases where it would not affect the suc- cess of that program. D. In recognition of the concern for social and economic problems, the City shall strive to provride for a cross-section of re',ident needs through a mixture of programs s as identified and supported by concerned residents. E. In recognition of the difficult, task of ckterninin g funding levels for social service programs, the City shall institute /i formal schedule that en:o!:lpdsses the entire Federal Revenue :Mar'in1 cycle wit.l► strict enforce- ment of all deadlines. In recognition of the desire to prevent organizations from realizing a profit from delivering social services, the City shall only accept applica- tions from non-profit, charitable organizations, registered with the State of Florida. H. In recognition of the need to closely monitor extienditures, the City shall establish standards as to quality and cost as guidelines for the purchase of all equipment and office supplies. I. In recognition of the City's concern for satisfying residents' desires and needs, all programs receiving funding must have been reviewed for such funding by that area's Citizen Participation Task Force.
