A RESOLUTION ACCEPTING THE BID OF GARCIA
ALLEN CONSTRUCTION COMPANY, INC. IN THE
PROPOSED AMOUNT OF $42,840 FOR THE CON-
STRUCTION OF OMNI PAVING PROJECT B-4384
(BID "C" LANDSCAPING); ALLOCATING THE
AMOUNT OF $42,840 FROM 7HE ACCOUNT ENTITLED
"HIGHWAY BOND FUNDS" TO COVER THE PROPOSED
CONTRACT COST; ALLOCATING FROM SAID ACCOUNT
THE AMOUNT OF $4,712.40 TO COVER THE COST
OF PROJECT EXPENSE; ALLOCATING FROM SAID
ACCOUNT THE AMOUNT OF $856.60 TO COVER THE
COST OF SUCH ITEMS AS ADVERTISING, TESTING
LABORATORIES AND POSTAGE; AND AUTHORIZING
THE CITY MANAGER TO EXECUTE A CONTRACT WITH
SAID FIRM.

WHEREAS, sealed bids were received on September'2D,
1976 for the construction of OMNI PAVING PROJECT B-4384; and
WHEREAS, the City Manager reports that the $42,840
bid of Garcia Allen Construction Company, Inc. is the lowest
responsible bid for for BID "C" LANDSCAPING of
Proposal and
recommends that a contract be awarded to said firm; and
WHEREAS, the City has entered into an agreement with
Omni International of Miami Ltd. and Popolopen Properties, Inc.
for the construction of subdivision improvements and authorizing
the City to expend funds for these improvements in the plat
entitled "OMNI INTERNATIONAL", and to collect said sum plus
interest from Omni International of Miami Ltd. over a 10-year
period, all in accordance with the agreement and letter amend-
ments attached hereto and made a part hereof; and
WEIEREAS, Section 54-20 of the Code of the City of Miami requires
the construction of certain street improvements in the City of Miami as a part of
the subdivision improvements of the record plat entitled OMNI I!JTERNATIONAL; and
WHEREAS, the City of Miami has agreed to construct
said highway subdivision improvements as a City of Miami
Highway Project using Highway Bond Funds; and
WHEREAS, Omni International of Miami Ltd. is the
Lessee of Tract "A" of the OMNI INTERNATIONAL SUBDIVISION and

ha§ agreed to pay the City of Miami the full cost of the projeot
including incidental expenses; and
WHEREAS, Popolopen Properties, Inc. is the owner
of Tract "A" of the subdivision known as OMNI INTERNATIONAL
as recorded in Plat Book 102 at Page 3 of the Public Records
of Dade County, Florida; and
WHEREAS, Popolopen Properties, Inc. has agreed to
subordinate its fee simple ownership in said subdivision to
the City of Miami's lien as provided in the aforesaid agree-
ment; and
WHEREAS, funds are available for allocation from
the account entitled "Highway Bond Funds" for the proposed
amount of the contract, for Project Expense and for such items
as Advertising, Testing Laboratories and Postage;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The September 20, 1976 bid of Garcia
Allen Construction Company, Inc. in the proposed amount of
$42,840 for the project entitled OMNI PAVING PROJECT B-4384,
namely, BID "C" LANDSCAPING of Proposal, based on unit prices,
is hereby accepted at the price stated therein.
Section 2. The amount of $42,840 is hereby allo-
cated from the account entitled "Highway Bond Funds" to cover
the proposed cost of the contract.
Section 3. The amount of $4,712.40 is hereby
allocated from the aforesaid account to cover the cost of
Project Expense which includes engineering, surveys, and
inspection work performed by City Forces.
Section 4. The amount of $856.60 is hereby allo-
_ cated from the aforesaid account to cover the cost of such
items as Advertising, Testing Laboratories and Postage.
Section 5. The City Manager is hereby authorized
to enter into a contract on behalf of the City of Miami
