RFC/rb 9/22/76 RESOLUTION NO. 76-824 A RESOLUTION ACCEPTING THE BID OF MARKS BROTHERS COMPANY IN THE PROPOSED AMOUNT OF $141,738 FOR THE CONSTRUCTION OF OMNI PAVING PROJECT 3-4384 (BID "B" STORM SEWERS); ALLOCATING THE AMOUNT OF $141,738 FROM THE ACCOUNT ENTITLED "STORM SEWER BOND FUND" TO COVER THE PROPOSED CONTRACT COST; ALLOCATION FROM SAID ACCOUNT THE AMOUNT OF $15,591.18 TO COVER THE COST OF PROJECT EXPENSE; ALLOCATING FROM SAD) ACCOUNT TI-HE AMOUNT OF $2,834.82 TO COVER THE COST OF SUCH ITEMS AS ADVERTISING, TESTING LABORATORIES AND POSTAGE; AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH SAID FIRM. WHEREAS, sealed bids were received on September 20, 1976 for the construction of OMNI PAVING PROJECT B-4384; and WHEREAS, the City Manager reports that the $141,738 bid of Marks Brothers Company is the lowest responsible bid for BID "B" STORM SEWERS of Proposal and recommends that a con- "DOCUMEN INDEX tract be awarded to said firm; and WHEREAS, the City has entered into a T eignt with Omni International of Miami Ltd. and Popolopen Properties, Inc. for the construction of subdivision improvements and authorizing the City to expend funds for these improvements in the plat entitled "OMNI INTERNATIONAL", and to collect said sum plus interest from Omni International of Miami Ltd. over a 10-year period, all in accordance with the agreement and letter amend- ments attached hereto and made a part hereof; and WHEREAS, Section 54-20 of the Code of the City of Miami requires the construction of certain street improvements in the City of Miami as a part of the subidivision improvements of the record plat entitled OMNI INTERNATIONAL; and WHEREAS, the City of Miami has agreed to construct said highway subdivision improvements as a City of Miami Highway Project using Storm Sewer Bond Funds; and WHEREAS, Omni International of Miami Ltd. is the Lessee of Tract "A" of the OMNI INTERNATIONAL SUBDIVISION and has agreed to pay the City of Miami the full cost of the project including incidental expenses; and CITY COMMJSSfON MEETING OF SEP 2 3 19iu RESOWilon m., ' [ (,(/,r' RF MARKS: WHEREAS, Popolopen Properties, Inc. is the owner of Tract "A" of the subdivision known as OMNI INTERNATIONAL as recorded in Plat Book 102 at Page 3 of the Public Records of Dade County, Florida; and WHEREAS, Popolopen Properties, Inc. has agreed to subordinate its fee simple ownership in said subdivision to the City of Miami's lien as provided in the aforesaid agree- ment; and WHEREAS, funds are available for allocation from the account entitled "Storm Sewer Bond Funds" for the proposed amount of the contract, for Project Expense and for such items as Advertising, Testing Laboratories and Postage; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The September 20, 1976 bid of Marks Brothers Company in the proposed amount of $141,738 for the project entitled OMNI PAVING PROJECT B-4384, namely, BID "B" STORM SEWERS of Proposal, based on unit prices, is hereby accepted at the price stated therein. Section 2. The amount of $141,738 is hereby allocated from the account entitled "Storm Sewer Bond Funds" to cover the proposed cost of the contract. Section 3. The amount of $15,591.18 is hereby allo- cated from the aforesaid account to cover the cost of Project Expense which includes engineering, surveys and inspection work performed by City Forces. Section 4. The amount of $2,834.82 is hereby allo- cated from the aforesaid account to cover the cost of such items as Advertising, Testing Laboratories and Postage. Section 5. The City Manager is hereby authorized to enter into a contract on behalf of the City of Miami with -2- Marks Brothers Company for the construction of OMNI PAVING PROJECT B-4384 (BID "B" STORM SEWERS).
