RESOLUTION NO. 16-793
A RESOLUTION AUTHORIZING THE DIRECTOR OF
FINANCE TO PAY TO MR. BAR'F VIDAL AND J.M.
PONTIAC, WITHOUT DIE ADMISSION OF LIABILITY,
THE SUM OF $1,793.22 IN FULL AND COMPLETE
SETTLEMENT OF A PROPERTY DAMAGE CLAIM AND
DEMAND AGAINST THE CITY OF MIAMI, UPON THE
EXECUTION OF A RELEASE, RELEASING TI-IE CITY
OF MIAMI FROM THE PROPERTY DAMAGE CLAIM
AND DEMAND.
WHEREAS, Mr. Bart Vidal filed a claim against the
City of Miami for alleged property damage, resulting from an
accident involving a City owned vehicle on May 7, 1976, at or
near the intersection of N.W. 19th Avenue and N.W. 18th Street

Miami, Florida; and
WHEREAS, the above claim has been investigated by
the Torts Division of the City Attorney's office in accordance
with Ordinance 8417, which creates the City of Miami's Self -
Insurance Program, and said Office recommends that this claim
be settled for the sum of $1,793.22;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the Director of Finance is hereby
authorized to pay to Mr. Bart Vidal and J.M. Pontiac, without
the admission of liability, the sum of $1,793.22 in full and
complete settlement of a property damage claim and demand
against the City of Miami, and upon the execution of a release,
releasing the City of Miami from all property damage claims and
demands,
PASSED AND ADOPTED this 9TH day of SEPTEMBER, 1976.

Settlement of Property Damage
Portion of Claim of Bart Vidal
Mr. Bart Vidal tiled a claim against the City of Miami for a.
property damage: resulting from an. accident involving a City
Police vehicle,
The accident occurred on May 7, 19 /6; at or near the intersection
of N.W. 19t.h .Avenue and 18t.h Street, Miami, Florida.
The City Police vehicle was souThbaund on N.W. 18th Street, passed
a stop sign at approximately 25 to 30 mi.I.es per hour, colliding
with an eastbound vehicle on N.W. J9th Street, which was traveling
at a. reasonable rate of speed for t-.he arca. The Police vehicle
was not on an emergency call, nor was there any emergency equip-
ment in use at the time of accident
The above claim has been investigated by the Torts Division of
the City Attorney's office, and in accordance with Ordinance
No. 8417 which creates the City of Miami Self --Insurance Program,
and said office recommends that this claim be settled for the
sum of $] , •'93 .22.
