THE READING OP THIS'ORDINANCE ON TWO SEPARATE DAYS

BE IT ORDAINED BY.THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1, For the purpose 'of paying the cost of street
lighting facilities in the City of Miami, including the ac
quisition, installation and relocation'thereof, the acquisition
of street lighting facilities owned by others, and the'ac-
quisition of any,necessary equipment,. land and rights of way,
there shall be issued under the. authority of the City Charter,
as amended, and subject to the election hereinafter, provided
for, an issue,ofbonds of the City of Miami in the aggregate
principal amount of not exceeding Ten Million Dollars
($10',000,000)', such bonds to be issued at one time or from
time. to time and to mature in the years and principal amounts,
respectively, as, follows:

trust company in the City of Chicago Illinois, or at a bank or
trust company in the City of Miami, Florida,, at the option of the
holder or registered owner, as shall be hereinafter designated by.
the Commission
The City Commission reserves, the right to make all or
a part of 'such bonds redeemable prior to their,. respective maturi-
ties at such time and prices and under such terms and conditions
as may be evidenced by resolution prior to the sale of the bonds.
Section 2. For the prompt payment of, the principal
of and interest on such bonds, there shall be levied and collec-
ted annually a special tax upon all taxable property within
the City, over and above all other taxes authorized to be levied
by the City of Miami, sufficient to pay such principal and interest
as the same respectively become due and payable.
Section,3. ,A special election is hereby called to be
held on the 28th day of September,.1976 for the purpose of sub-
mitting to the electors of the City authorized by law to parti-
cipate in such election the questions of whether such bonds shall
be issued.
Section 4. ,This ordinance is hereby declared to be.
an emergency measure upon the ground of urgent public need for
the preservation of peace, health, safety and property in the
City of Miami.
Section 5. Pursuant to Section 58 of the Charter of
the City of Miami, this ordinance shall go into effect immediately.

City -Owned Street Lighting
The City of Miami presently leases its street lighting from the
Florida Power and Light Company. However, recent rate increases,
plus action by outside sources attempting to secure competitive
bids for street lighting;, encouraged the City to undertake a
comparative study of City ownership versus continued leasing. For
City ownership to be financially feasible, three factors must be
realized; and the total annual cost of these should he less than
the cost of leased lighting. These factors are (a) receipt of
acceptable bids for both :installation and maintenance of City -
owned street lighting facilities; (b) acceptable pole attachment
agreements permitting the City of I•iiami, at minimal or no cost,
to mount its street lights to certain poles owned by Florida Power
and Light and Southern Ibel.l; and (c) a means of financing the
necessary capital costs involved for a City -owned system. A
discussion of these three factors, together with their present
status, follows.
Receipt of Bids for Installation and Maintenance - On
April 30, 1976.the City advertised for bids for instal-
lation and maintenance of City -owned street lighting
facilities. Two bids were received for the installation
portion and one for the maintenance portion. (The
maintenance contract covers a three year period.) These
were for a one square mile area. Considering the rela-
tive limited size of the area involved, the bids
received are acceptable. The installation bid holds
firm until December 11, 1976; the maintenance contract
would begin following installation.
Securing Pole Attachment Agreements With Utility Companies
After much effort the City has received from Florida
Power and Light their draft of an agreement that would
permit the City to install City -owned street lighting
facilities on Florida Power and Light poles. There are
many aspects of the Florida Power and Light proposal
that the City does not find agreeable. This is presently
being negotiated in an effort; to achieve an agreement
more acceptable to the City. Regarding the mounting of

City -owned street lights to Southern Bell utility poles,
the City is making provisions for this in the franchise
agreement with Southern Bell which is now under negotiation.
Financing a City -Owned Street Lighting System - It is
presently planned that the financing of a City -owned
system would come from two sources. The capital outlay
for the initial installation would come from a General
Obligation Bond Issue. The City's street lighting would,
therefore, be financed the same as any other City con- .
struction, such as highways, sewers, or public buildings.
The annual cost for maintenance and power would come
from funds which otherwise would be going to Florida
Power and Light for payment of leased lighting. Actually,
if the financial comparison proves feasible, the total
amount necessary to both pay off the obligation bonds,
and pay the annual maintenance and power costs, would be
no more than the amount that would be required to pay
Florida Power and Light for leased lighting. Once the
bonds are paid off, the City's annual costs would then
be reduced to considerably less than the costs for
continued leased lighting. As an appropriate amount to
initiate this program, the City Commission has authorized
a $10 million bond issue to he voted upon in September,
1976. These funds would provide City -owned lighting for
those portions of the City which do not now have sodium
vapor lighting. An estimated cost for a total Citywide
City -owned street lighting system is $20 million. In the
future, a referendum will he scheduled for a bond issue
for the remaining $10 million. These funds will be used
to purchase from the Florida Power and Light Company
sodium vapor lighting already installed.
At this time it appears that the financial feasibility of this is
going to depend largely upon the City securing favorable terms in
its proposed pole use agreement being negotiated with Florida
Power and Light.
