THEREOF IN CONFLICT;'AND CONTAINING A
SEVERABILITY PROVISION.
WHEREAS, current urban problems, due to the
complexity of modern economic life, necessitate an expendi-
ture of time and effort on the part of City Commissioners far
exceeding that envisioned by the framers of the Charter of
the City of Miami; and
WHEREAS, the last Charter, Amendment increasing
the salary of City Commissioners to $5,000 took place more
than 25 years ago; and
WHEREAS, a salary of $12,000 for the position
of City Commissioner and $15,000 for the position of Mayor of
the City of Miami is proper compensation to be paid qualified,
persons for services in these positions; and
WHEREAS, the Board of County Commissioners for
Dade County, Florida, on July 20, 1976, must approve the ballot
form of any Charter Amendment question prior to placement on the
first or second primary ballot;
NOW, THEREFORE, BE IT ORDAINED BY THE COMr4ISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The City Commission of the City of Miami
hereby submits the following proposed Charter Amendment for
submission to the electors of the City of Miami at the Special
Municipal Election on September 28, 1976, to become effective
upon its approval by the electors;

(h) Salafies of commission. Effeotito

commissioners of the City of Miami, Plorida,
except the mayor= Cotrtnissioner, by the City of
Miami as compensation, the sum of $5;999:-88
$12,000 per year for each commissioner, payable
monthly in twelve equal installments, and there
shall be paid by the City of Miami to the mayor-
commissioner as compensation ark- eaditienal -se +
netite'-e teeed- $8;599: the sum of $15,000
annually, payable monthly in twelve equal
installments,_ and there shall be paid by the
City of Miami to the mayor- commissioner an
additional sum not to exceed $2,500.00 annually
to be used by the mayor-commissioner to cover
any or all entertainment expenses of the office
of mayor - commissioner of the City. of Miami,
Florida.

the additional compensation of $2,500.00 to be
paid to the mayor- commissioner, as provided in
section 1 [the preceding paragraph] hereof, shall
be paid beginning December 1, 1949.
Section 2. The proper City officials are instructed
and directed to take the actions necessary for the submission
of this "Proposed Charter Amendment No. 1" to the electors, of
the City of Miami by placing it on the ballot as CHARTER AMENDMENT
NO. 1 in substantially the following form:
Shall Section 4(h) of the Charter of the
City of Miami, Florida, be amended to provide for
an increase in the salaries to be paid to City
Commissioners from the $5,000 previously established
in 1949 to $12,000 annually effective November 10,
1977 and for an increase in the salary of the Mayor-
Commissioner from the $5,000 previously established
in 1949 to $15,000 annually, effective November 10,
1977?

Section 4, If any section, sentence, clause► phrade,
or Word of this ordinance is for any reason held 'o± declared
to be unconstitutional, inopetatiVe, or void such holding or
invalidity shall not affect the remaining portions of this
ordinance; and it shall be construed to have been the intent
of the Commission of the City of Miami to pass this ordinance
Without such unconstitutional, invalid, or inoperative part
therein; and the remainder of this ordinance, after the exclu-
sion of such part or parts, shall be deemed and held to be
valid as if such parts had not been included therein.
Section 5. This ordinance is hereby declared to be
an emergency measure on the ground of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami.
ection 6. The requirement of reading this ordi-
nance on two separate days is hereby dispensed with by a four -
fifths vote of the members of the Commission.
