Section 28 of Article IV of the Comprehensive Zoning Ordinance reads as follows: "Commercial vehicles, other than those accessory to a permitted use, shall not be parked or stored on any property located in an R-1, R-1A, R-1B, R-2, R-3, R-4, R-5, R-C, C-11, C-2 District." 2. A commercial vehicle is defined in the Comprehensive Zoning Ordinance as follows: "Any vehicle designed, intended for use for transporta- tion of people, goods, or things other than private passenger vehicles and trailers or private non-profit transport of goods and/or boats." 3. In 1972 the Zoning Division received complaints from neighbors with reference to the parking of a truck and various other equipment at 2235 S. W. 35 Terrace. 4. In 1973 the owner of the property, Mr. Pablo Ramirez, agreed to limit the parking of vehicles on this property to one truck which was to be his only means of trans- portation. 5. In' November of 1975, the Zoning Division received complaints from neighbors with reference to parking of commercial vehicles at 2235 S. W. 35 Terrace, and excessive noise as early as 5 AM. Several re -checks were made, and on February 21st a certified letter was mailed to Mr. Ramirez. 6. On April 22nd reinspection indicated non-compliance, and an information was filed in the Metro Court. The Honorable Judge Robert Deehl heard the matter at arraignment, and set the case down for trial. el41 ��7.1""'t CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO. Ferre Mayor DATE: SUBJECT: REFERENCES: ENCLOSURES: June 29, 1976 FILE: Parking of Commercial Vehicles in Residential Areas (Mr. Pablo Ramirez) On.several occasions, working men have complained to my office of neighborhood problems arising out of the inability to park commercial vehicles, their only source of transportation, in residential neighborhoods. The most recent case, that of Pablo Ramirez, 2235 S.N. 27 Terrace, to be heard before Judge R. Dechi on July 7, 1976, deal!-'. with ,a ccnp1aint issued by a City of Miami zoning inspector because Mr. Ramirez parks his van in the driveway of his home in the evenings, after he returns from work. Mr. Ramirez's van is a normal -size wagon the size of a station wagon that simply has the name of his fi.rrn painted on the outside. [t is his only form of transportation and obviously causes him a hardship if unable to use it. He could easily bypass the law by painting over the sign on the side of his van and hanging a removable sign as he leaves his house every day but, as a matter of principle, he has petitioned the Commission to review this matter. He has brought to my attention photos of many other working men who also park their vans in their property in the evenings, some being carpenters, others plumbers or painters. It is his contention that he is being singled -out by neighbors whose basic concern is not that he parks his van in his driveway, but rather who use this as a vehicle to vent thely feelings :bout their. Cuban neighbor. Be that as it may --and I make no case for him --I think there is merit in the general situation that this problem speaks to and I would like it studied by the Administration and hopefully placed on the Agenda for the July 22 Commission meeting for discussion and action if possible by the Commission.
