Dear Mr, Crumpton:
Under date of March 30, 1976 I addressed to the Honorable Paul
Andrews, City Manager, a letter concerning The Charter Club,
copy of which is enclosed herewith for identification.
As a result of that letter you scheduled an appearance for me
before the Miami City Commission in May, 1976 to present the
subject matter discussed in the letter. Prior to the Commission
meeting I notified you that due to certain financial difficulties
which had been encountered by my client at that time (Biscayne
Bay Development Corporation) that I had been instructed to request
that the item be withdrawn from the agenda until the matter of
finances had been resolved. Accordingly, the item was withdrawn
and not: heard.
I am now advised that the financial structure of The Charter Club
has been reorganized and Protean, Inc. is the owner. I have
been instructed to proceed with all due haste in seeking an
appearance before the Miami City Commission to achieve the
relief discussed in the letter of March 30, 1976. The subject
matter thereof is most important to my client and could determine
the future success or failure of the venture; and equally as
important, time is now of the essence.
Accordingly, I would respectfully request that the item be re-
scheduled at the earliest practical moment on the agenda of

Dear Mr. Andrews:
This firm represents the developers of the Charter Club, a
COndoininuiln development located in a R-5 District of the City
of Miami.
My clients find tilei.,selves in the same relative circumstances
as other condominium developers at this time due to economic
conditions prevalent in South Florida - a marked slowdown in the
sales of such units. You are undoubtedly aware of the condi-
tions and have found that governmental authorities as well as
private interests have been called upon frequently to render
assistance and to facilitate recovery on the part of developers,
mortgage holders, and other interested parties in various real
estate ventures.
These conditions have caused the Charter Club to experience a
slow down in the sale of its units and although recent trends
seem to indicate a better economic climate ahead, nevertheless,
my clients believe that they require some assistance with regard
to zoi-ling uses which iiiay be permitted in R-5 Districts in order
to insure a reasonable likelihood of success. We refer to the
fact that develops:,tints such as the Charter Club frequently in
this day and time, have mixed uses, particularly residential and
professional office space.

Our examination of the existing Comprehensive Zoning Ordinance,
the Rules and Regulations of the City of Miami, and the results
of a conference which we have held with Mr. George Acton, Director
Planning Department, City of Miami, indicate that existing law
does not provide sufficient leeway within a R-5 District to perrnit
sales of units for professional office space, We believe that
such zoning authority is essential to enable the Charter Club and
similar ventures to become a viable development.
Therefore, the developers of the Charter Club find it necessary
to turn again to the Miami City Cocnissi.on and request considera-
tion of this pressing problem by directing public hearings to be
held by the Planning Advisory ,Board and/or the City Commission to
study the feasibility and possibility of adopting some amendment
or modification to the CZO which would permit reasonable amounts
of floor area in such develop. :cnts un(lcr proper protective condi-
tions to be utilized for professional office space (mixed
residential and professional office space) .
My clients believe that if the Charter Club and similar type
buildings in R-5 Districts ,.:care permitted to utilize up to 20%
of the total floor rir.ea (possibly limited to the lower three or
four floors) that this would materially enhance the likelihood
and success of the Charter Club and similar ventures.
Please understand that we are not necessarily suggesting that the
only method of obtaining relief would be by modification of the
CZO through conditional use or otherwise, but we find that before
the matter can be explored to ascertain any other avenues for
relief, that it requires an appearance before the Miami City
Commission for discussion of the problem.
Therefore, kindly consider this letter a request to be placed upon
the agenda of the Miami City Co,nrnissi.on at the earliest possible
time for the purpose of describing the problem to the City Commis-
sion for its determination of whether or not the matter should be
referred to the Planning Advisory Board or such other method of
obtaining relief as would permit the uses requested.
