RESOLUTION NO. 76-746
A RESOLUTION AUTHORIZING THE DIRECTOR OF
FINANCE TO PAY TO MRS. FRANCISCO DUARTE,
WITHOUT THE ADMISSION OF LIABILITY, THE
SUM OF $1,000.00 IN FULL AND COMPLETE
SETTLEMENT OF ALL CLAIMS AND DEMANDS
AGAINST THE CITY OF MIAMI, UPON TIIE EX-
ECUTION OF A RELEASE RELEASING THE CITY
OF MIAMI FROM ALL CLAIMS AND DEMANDS.
WHEREAS, Mrs. Francisca Duarte, has filed a claim against
the City of Miami for damage incurred for medical bills and
pain and suffering on May 20, 1975, through her attorney,
Mr. Miguel A. Suarez, in the amount of $2,500 when she tripped
and fell on an unlcvcl sidewalk at Northwest 12th Avenue &
Northwest 1st Street, in the City of Miami; and
WHEREAS, this claim has been investigated by the office
of the City Attorney and said office recommends that this
claim be settled for the sum of $1,000.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the Director of Finance is hereby
authorized to pay to Mrs. Francisca Duarte without admission
of liability, the sum of $1,000 in full and complete settle-
ment of all claims and demands against the City of Miami, upon
the execution of a release releasing the City of Miami from
all claims and demands.
PASSED AND ADOPTED this 22 day of JULY
1976.

Settlement of claim against
the Ci':y
Francisca Duarte vs. City
Resolution
The Cit•.' of Miami Law Department received a claim for personal
injury from Mrs. Francisca Duarte who tripped and fell on an
allegedly defective public sidewalk at or near the intersection
of N. W. 12th Avenue and N. W. First Street, Miami, Florida, on
May 20, 1975.
As a result of this accident, Mrs. Duarte sustained injury to
the epiyas.:ric area and to her left knee. She received medical
trea'.ment, includin:r flat of an orthopedic doctor who gave her
a 20• disabilit • ra. inc; of ':lie left knee, and recommended
surger-:. The total of Mrs. Duarte's t;.edcal bills amounted to
$340.00.

Mr. Mario Santana, Legal In•:esti ator of the Law Department,

Cased upon the advice of loth Mr. Santana and Mr. Jose n .
Alvarez, Director of the Torts Division of Lhi.s office, and in
lieu of considera>>l_' hiVer exposure to the Cic•, it is my
recommendation that the above claim be settled for the sum
of $1, 000.00.
