BARTLEY AND BAIR, ABERNATHY AND ASSOCIATES FOR PROFESSIONAL CONSULTING SERVICES, IN CONNECTION WITH THE REVISION OF THE CITY'S COMPREHENSIVE ZONING ORDINANCE; WITH FUNDING FOR SAID AGREEMENT FROM COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS; FURTHER AUTHOR- IZING AND ESTABLISHING DAILY COMPENSATION RATES FOR SAID SERVICES WITH THE TOTAL AMOUNT PAYABLE THEREFOR NOT TO EXCEED $50,000; AND PROVIDING FOR THE COMPLETED PERFORMANCE OF SAID AGREEMENT NO LATER THAN 12 MONTHS FROM THE DATE OF EXECUTION OF SAID AGREEMENT. WHEREAS, the City of Miami has previously engaged the services of DR. ERNEST R. BARTLEY for planning consulting services leading to the adoption of Ordinance #8234 dated February 28, 1974 (City Code Chapter 62) which established the Planning Advisory Board,and Zoning Board as separate entities; and WHEREAS, the City of Miami has previously engaged consultants for the preparation of the Miami Comprehensive Neighborhood Plan by Resolutions No. 75-239 and No. 75-240 dated March 12, 1975, including DR. ERNEST R. BARTLEY and BAIR, ABERNATHY AND ASSOCIATES as sub-consu a(Jt rfOx TlD En a v use controls; and t l� ITEM NO._ /7/ J WHEREAS, DR. ERNEST R. BARTLEY and BAIR, ABERNATHY ft AND ASSOCIATES have substantially completed their work in Phase III of the Miami Comprehensive Neighborhood Plan, being recommendations for comprehensive revisions to the Comprehensive Zoning Ordinance #6871; consistent with the land -use recommenda- tions of the Miami Comprehensive Neighborhood Plan; and WHEREAS, the City of Miami desires to extend the sub -consultants' professional consulting services for land -use controls for DR. ERNEST R. BARTLEY and BAIR, ABERNATHY AND ASSOCIATES to enable them to prepare a revised text and schedule of district regulations for the Comprehensive Zoning CITY COMMISSION MEETING OF JUL 2 2 1976 RESOLUTION NO. /..... REMARKS: Ordinance #6871 (Phase iV of the Miami Comprehensive Neighborhood Plan) ; and WHEREAS, the second year application for Community Development Block Grant funds submitted by the City of Miami to the U.S. Department of Housing and Urban Development dated February 20, 1976 (Resolution No. 76-191 dated February 10, 1976) identified Planning and Management Development as an eligible activity of which Phase IV of the Miami Comprehensive Neighborhood Plan is a part; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized and directed to negotiate and execute a contract with DR. ERNEST R. BARTLEY and BAIR, ABERNATHY AND ASSOCIATES, for professional consulting services in connection with the revision of the City's Comprehensive Zoning Ordinance. Section 2. The proper City Officials are hereby authorized to compensate DR. ERNEST R. BARTLEY and BAIR, ABERNATHY AND ASSOCIATES for said services, in accordance with the following established rates, with the total amount payable therefor not to exceed $50,000; with funds therefor hereby allocated from Community Development Block Grant Funds: A. Upon the submission to the Planning Department of monthly billings in triplicate over the signature of DR. ERNEST R. BARTLEY, payment shall be made by the proper City Officials to DR. ERNEST R. BARTLEY, within 45 days of receipt of such billings, as follows: (1) $350 per. 8-hour day for FREDERICK H. BAIR, JR; (2) $325 per 8-hour day for DR. ERNEST R. BARTLEY. B. The City shall not be•billed for any transportation or living expenses of DR. ERNEST R. BARTLEY and BAIR, ABERNATHY AND ASSOCIATES. The City will be billed for any professional expenses incident to the preparation of the draft of the text and the schedule of district regulations such as drafting of necessary -2- diagrams, physical preparation of the milar schedule, photo= graphic reduction of the schedule. Section 3. A. DR. ERNEST R. BARTLEY and BAIR, ABERNATHY AND ASSOCIATES shall deliver the draft copy of the revised ordinance text and the schedule of district regulations of a proposed new zoning ordinance in the prescribed form to the Planning Department no later than 12 months from the date of the execution of the aforesaid agreement. The draft of the text and the schedule of district regulations shall reflect changes in language that may be required after appropriate consultations with the City Commission, Planning Department, Planning Advisory Board and Zoning Board of the City. B. In the process of completing the afore- said draft and schedule, DR. ERNEST R. BARTLEY and BAIR, ABERNATHY AND ASSOCIATES shall perform the nature of and follow the order of tasks and conform generally to the time limitations as required by said agreement.
