RESOLUTION NO. 76-708
A RESOLUTION AUTHORIZING AND DIRECTING THE
CITY MANAGER TO EXECUTE A QUIT CLAIM DEED
CONVEYING TO MANUEL SANCHEZ AND DIRIAN D.
SANCHEZ, HIS WIFE, THE SOUTH 7.50 FEET OF LOT
3, BLOCK 31, OF IDLEWILD PARK (2-87) AS SHOWN
ON THE SKETCH ATTACHED HERETO AND MADE A PART
HEREOF.
WHEREAS, in 1926, the City of Miami received deeds of
dedication conveying the south 7.50 feet of Lots 3 and 4, Block 31,
of IDLEWILD PARK (2-87) for the purpose of widening S.W. 3rd
Street (formerly known as S.W. 4th Street); and
WHEREAS, since S.W. 3rd Street is abutted only by Lot 4
and by no portion of Lot 3 (Lot 3 abuts Lot 4 to the north as shown
in the attached drawing), only the south 7.50 feet of Lot 4 was
required by the City to bring S.W. 3rd Street to its presently
zoned width; and
WHEREAS, it is obvious that the intent of said dedications
was to convey to the City only the south 7.50 feet of Lot 4 and not
any portion from Lot 3; and
WHEREAS, under the circumstances, it is only equitable for
the City of Miami to disclaim any and all interest it has in said
Lot 3, now that a request for same has been made by the present
abutting owners of Lot 3;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The City Manager is hereby authorized and
directed to execute a quit claim deed disclaiming whatever interest
the City of Miami has in and to the south 7.50 feet of Lot 3, of
Block 31, of IDLEWILD PARK (2-87) to the present abutting owners
f record, Manual Sanchez and Dirian D. Sanchez,nnnhis wife.
