A kESOLUTION GRANTING THE REQUEST AS PER ORDINANCE
4O. 6871, ARTICLE IV, SECTION 36(2), FOR THE USE
OF A PORTION OF THE STRUCTURE LOCATED ON TRACTS A
& B, DELAWARE PARK SECTION 1 (40-17), BEING 2929
N.W. 17TH STREET, BY THE "EXCEPTIONAL CHILDREN'S
SCHOOL AND NURSERY HOME, INC." A SCHOOL FOR
MENTALLY RETARDED CHILDREN, BEING AN ELEEMOSYNARY
USE, ZONED R-C (RESIDENTIAL OFFICE) DISTRICT.
WHEREAS, the Miami Planning Advisory Board at its
meeting of July 21, 1976, Item No. 1 , following an advertised
Hearing adopted Resolution No. PAB 21-76 by a 5 to 0 vote
recommending approval for an eleemosynary use as hereinafter set
forth; and
WHEREAS, this Commission deems it essential and
c:esirable to the public convenience and welfare and finds that the
use will not be detrimental or injurious to the character of
the development of the immediate neighborhood;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The request as per Ordinance No. 6871,
Article IV, Section 36(2) for the use of a portion of the structure
located on Tracts A & B DELAWARE PARK SECTION 1 (40-17), being
2929 N.W. 17th Street, by the "Exceptional Children's School and
Nursery Home, Inc.," a school for mentally retarded children,
being an Eleemosynary Use; zoned R-C (Residential Office) District,
be, and the same is hereby granted.
PASSED AND ADOPTED this 22 day of JULY , 1976.

Request in accordance with Ordinance 6871, ARTICLE IV, Section 36 (2),
for the use of a portion of the above structure by the "Exceptional Children's
School and Nursery Home, Inc. , " a school for mentally retarded children;
being an Eleemosynary Use; zoned R-C (Residential -Office).
EXPLANATION:
This use is excluded from the R-C zoning district; institutions of this
nature are allowed only in the R-4 (and more liberal) zoning districts.
However, the applicant has qualified as an eleemosynary use under the
provisions of Article IV Section 36 (2) of the Comprehensive Zoning Ordinance
and this use can be located in any District from which it is otherwise excluded,
upon recommendation of the Planning Advisory Board and authorization by
the City Commission.

The Sunrise School for the Retarded has made an appeal for
special administrative and City Commission assistance in
considering their application for eleemosynary use of the
property located at 2929 N.W. 17th Street (Parkway facility).
Their letter of request is attached and expresses the
emergency condition-; that exit on the continuation of their
servicing 53 handicapped, retarded children.
In an effort to assist the Sunrise School for the Retarded,
the Administration has placed this matter on the July 22,
City Commission Agenda and has publicly advertised and noticed
interested parties.At the July 21, 197G, Planning Advisory
Board Meeting, an announcement will be made of the proposed
July 22 City Commission consideration of this item.
Due to the physical inability to provide the Miami City
Commission with the written minutes and action of the Planning
Advisory Board, the Sunrise School for the Retarded is asking
the City Commission to waive the five day rule and to take
formal action on this matter at their July 22 City Commission
Meeting. A verbal explanation of the factors involved and the
action of the Planning Advisory Board, will he given by the
staff, if you choose to hear this item.

The purpose of this letter is to request that Sunrise School,
a residential care facility serving 53 multiply handicapped
retarded children, be added to the July 22, 1976 City of Miami
Commission hearing agenda as an emergency item for consideration.
Sunrise School for the Retarded has secured a lease from Dade
County for partial use of a building presently being used by
Dade County's Division of Youth Services located at 2929 NW 17 St.
in the City of Miami. It is our understanding that the request
to occupy this building, will be presented to the City of Miami's
Planning and Advisory Board for their review and recommendation
on July 21, 1976.
We have been informed that there is an ordinance which prohibits
any item from being placed on the commission agenda unless it is
received by the commission at least eight days prior to the
hearing. Since, in this case, the decision of the Planning
Advisory Board can only be ascertained one day prior to the
commission hearing, we are requesting that the eight day stipulation
be waived so the commission can act on the board's recommendations
on July 22, 1976.
We are aware of the gravity of this request and the hardships it
may work upon your staff. However, Sunrise School must occupy the
Parkway Facility on August 1, 1976 in order to retain certification
as a Medicaid provider under Title XIX, a federal reimbursement
prograu for intermediate care facilities serving the rr.entally
retarded (ICF/Mf).

Sunrise School's precarious financial situation and the condition
of its presently condemned buildings, mandate ar. August 1st occupancy

does not have the resources to operate until September, the next
cerrmission hearing, without federal financial assistance. This
federal assistance cannot be secured urtil Sunrise occupies a
facility that structurally meets the requirements of the Medicaid
Program.
Therefore, unless the City of Miami's Commissioners arras willing to
review the Planning Advisory Board's recommendations on July 22, 1976,
fifty three retarded children, presently receiving quality care on
a very personal level, will be transferred to one or more of the
State's overpopulated Sunland Training Centers.
The fact that this agency, praised by federal and state authorities
as being one of the finest serving profoundly retarded children, may
fail within three weeks of securing federal support is a cruel,
tragic and unacceptable conclusion to months of struggling by
hundreds of people connected with the effort to save Sunrise School.
Anything the great City of Miami can do to expedite this request,
thus saving the school, will be remembered and appreciated by us
all.

Last Tueedayl night at gur regular Association meeting
Mr. Les Leech, Executive Director and Dr. George Spelios,
President of the Board -of Directors of Sunrise school for
the Retarded met awl spoke with our -members. After their
presentation, a motion was. made and seconded by the Assoc-
iation to recommend to ypu and the County Com.rr.ission that
they lease ,the property as temporary quarters for their
patients while new i'acilities are built for them in South
Dade County. They assured us, that they have a very capable
staff, their plans.for.refurbtshing the property will more
than meet -the -State, County and City.safety codes and they
will be valuable to our community. Mention was made of the
pool, too. Mr. Leech' said they would not be able to use
this part of the propert, due to the limitations of the
patients. During 'our discussion on thin matter many agreed
the pool should be covered and landscaped or filled with
dirt as a safety feature for future tenants or leasors.
