HomeMy WebLinkAboutR-76-0578MtA 6/7/76 RESOLUTION NO. 76-578 A RESOLUTION AUTHORIZING AND DIRECTING THE DIRECTOR OF FINANCE TO PAY ATTORNEY'S FEES AND COSTS IN THE TOTAL AMOUNT OF $28,472.47 TO JOHN R. FARRELL, P.A., AS ATTORNEY FOR THE DEFENDANT -OWNER OF PARCEL NO. 7093-B ARISING FROM A CONDEMNATION ACTION, CITY OF MIAMI VS. PATTERSON, ET AL., CASE NO. 75- 10961; AND FURTHER AUTHORIZING AND DIRECTING THE ALLOCATION OF SAID FEESAND COSTS FROM THE PARKS FOR PEOPLE BOND FUND. WHEREAS, by Resolution No. 74-342 the City Commission directed the City Attorney to acquire by condemnation the parcel described in said Resolution in order to complete the Dallas Park facility; and WHEREAS, by statute the City of Miami, the condemning authority, is required to pay the Defendant's reasonable costs and attorney's fees; and WHEREAS, John R. Farrell, P.A. was retained by the owners of Parcel 7093-B; and WHEREAS, by Court Order, after a hearing on Defendant's motion for entry of an order assessing attorney's fees and a motion to tax costs, John R. Farrell, P.A. was awarded attorney's fees in the sum of $22,500.00 and costs in the sum of $5,972.47; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Finance Director be and he is hereby authorized to pay to John R. Farrell, P.A., as Attorney for the Defendant -Owner of Parcel No. 7093-B, attorney's feesand costs in the total sum of $28,472.47. Section 2. The Finance Director be, and he is hereby authorized and directed to allocate the said sums from the Parks for People Bond Fund. Patterson, et al Case No. 75-10961 (Dallas Park) The City of Miami condemned the final parcel for Dallas Park. (A portion of said park will be used for the Miami River Walkway). In connection with the Condemnation the Defendants incurred costs in the sum of $5,972.47 and the Court awarded attorney's fees in the sum of $22,500.00.
