RESOLUTION NO. 76-577
A RESOLUTION AUTHORIZING AND DIRECTING THE
DIRECTOR OF FINANCE TO PAY ATTORNEY'S FEES
AND COSTS IN THE TOTAL AMOUNT OF $4,145.60
TO JOHN R. FARRELL, P.A., AS ATTORNEY FOR
THE DEFENDANT -OWNER OF PARCEL NO. 7095.3
ARISING FROM A CONDEMNATION ACTION, CITY OF
MIAMI VS. GISELLE FASHIK, ET AL., CASE NO.
74-21840, a/k/a AFRICAN SQUARE; AND FURTHER
AUTHORIZING AND DIRECTING THE ALLOCATION OF
SAID FEESAND COSTS FROM THE PARKS FOR PEOPLE
BOND FUND.
WHEREAS, by Resolution No. 74-342 the City Commission
directed the City Attorney to acquire by condemnation the parcel
No. 7095.3 in order to complete the African Square Park facility;
and
WHEREAS, by statute the City of Miami, the condemning
authority, is required to pay the Defendant's reasonable costs
and attorney's fees; and
WHEREAS, John R. Farrell, P.A., was retained by the
owner of Parcel No. 709 5. 3; and
WHEREAS, by Court Order, after a hearing on Defendant's
motion for entry of an order assessing attorney's fees and a
motion to tax costs, John R. Farrell was awarded fees in the sum of
$2,750.00 and costs in the amount of $1,395.60;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The Finance Director be and he is hereby
authorized to pay to John R. Farrell, P.A., as Attorney for the
Defendant -Owner of Parcel No. 7095.3, attorney's fees and costs in
the total sum of $4,145.60.
Section 2. The Finance Director be, and he is hereby
authorized and directed to allocate the said sums from the Parks for
People Bond Fund.

Case No. 74-21840
(African Square Park)
The City of Miami condemned the parcel of property used by Dr.
Nadler for the African Square Park Facility.
In connection with the Condemnation the Defendant -owner incurred
costs in the sum of $1,395.60 and the Court awarded attorney's
fees in the sum of $2,750.00.
Attached hereto is a Resolution for Costs and Attorney's Fees
in the total amount of $4,145.60.
