HomeMy WebLinkAboutR-76-0564RESOLUTION NO. 76-5 54 A RESOLUTION CANCELLING A COVENANT TO RUN WITH THE LAND POSTPONING THE IMMEDIATE CONSTRUCTION OF ASPHALTIC CONCRETE PAVEMENT (REMACADAMIZE) ON THE PORTION OF THE STREETS ABUTTING FLOYD'S GROVES ESTATES 3RD ADDITION (82-56). WHEREAS, on June 12, 1967, the City Commission passed and adopted Resolution No. 38751 accepting the plat entitled FLOYD'S GROVES ESTATES 3RD ADDITION and the agreement between The City of Miami and Ralph J. Repp and Rose K. Repp for the construction of asphaltic concrete pavement (remacadamize), a storm drainage structure and landscaping; and WHEREAS, at the request of the owner, the Department of Public Works restudied the condition of the pavement in the vicin- ity of S.W. 5th Street and 39th Avenue and it was determined that the resurfacing of the streets could be postponed until such time as they could be incorporated into a high\: -ay improvement; and WHEREAS, the Director of the Department of Public Works recommended that a Covenant To Run With The Land be accepted post- poning the immediate construction of pavement on S.W. 5th Street and 39th Avenue abutting the property platted and that the Director of Finance be authorized to release the funds deposited with The City to guarantee all the required subdivision improvements; and WHEREAS, Resolution No. 39544 was passed and adopted March 28, 1968, which released the said funds and which also accepted the aforesaid Covenant To Run With The Land duly executed by said owners on March 12, 1968 and subsequently recorded on May 17, 1968 in Official Records Book No. 5947, at Page 367, of the Public Records of Dade County, Florida; and I T E IV PI CITY COMMISSI-ON MEETING OF JUN (; 976 RESOLUTION RtMARKS: WHEREAS, the Department of Public Works has checked the existing pavement and the placement and finds that it is in acceptable condition of asphalt will not be required at this time, but will be included in a highway improvement district at a later date; and WHEREAS, the owner has requested that said Covenant To Run With The Land be cancelled of record. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the March 12, 1968 Covenant To Run With The Land executed by Ralph J. Repp and Rose K. Repp postponing the immediate construction of asphaltic concrete pavement on S.W. 5th Street and S.W. 39th Avenue be cancelled. Section 2. The City Attorney is hereby directed to prepare an instrument \which will formally cancel the aforesaid instrument; and the City Manager is hereby authorized and directed to execute same.
