W, BECK AND ASSOCIATES TO PROVIDE TECHNICAL ASSISTANCE 80TH PRIOR TO AND DURING THE CURRENT FRANCHISE NEGOTIATIONS WITH SOUTHERN BELL TELEPHONE AND TELEGRAPH COMPANY, INC,, WITH THE ACTUAL COMPENSA•- TION TO BE PAID R. W. BECK AND ASSOCIATES NOT TO EXCEED $10,000; ALLOCATING FUNDS FROM THE EXECUTIVE SURPLUS SALARY ACCOUNT, WHEREAS, the Franchise Agreement Bell Telephone and Telegraph Company, Inc. tiated and approved by the City Commission with Southern must be renego- and the voters prior to August 12, 1976, the date of expiration for present agreement; and WHEREAS, the City Commission requested the Manager on January 8, 1976 to engage an expert as a the City consul- tant for the purpose of writing a new Franchise Agreement due to the complex issues and ramifications resulting from passage of laws and regulations; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF MIAMI, FLORIDA: TKF,;,;QOMISSION ITEM NO Section 1. The action of the City Manager in en aging the services of R. W. Beck and Associates on the project of the Southern Bell Telephone Company franchise negotiations in accordance with the work order, attached hereto and made a part hereof, is hereby approved and ratified, there being an express limitation of $10,000 as the maximum amount to be paid said R. W. Beck and Associates without further prior approval by the City Commission. Section 2. Funds for the payment to the aforesaid R. W. Telephone rrat chise Negotiations L Southern Dell/City of Mianni Scope of Services The work is' divided into two phases: (1) preparations for negotiations and Z) actual negotiations. Ma The scope of work to be undertaken during the first phase, preparation for negotiation: will include meetings with the City Manager and his staff, the City Attorney, and possibly legal counsel that the City may engage to further assist in this matter. The purpose of these meetings is to develop a comprehensive list of issues to be taken up in the negotiations and to establish the Cityts initial position with respect -to each of those issues. It is contemplated that -this work will also involve analyzing Bata with respect to the Southern Bell operations in the City of Miami based on information on file with the City or with the Florida Public Service Commission. The length of time for this phase of the work will be approximately thirty days. Based upon the time schedule and personnel devoted to the work, .the cost of this phase under R. W. Beck and Associates standard salary multiplier form of compen- sation, plus out of pocket'exoenscs, will be in the range of $7, 500 - $10, 000, but is not to exceed $10, 000 witriout prior approval by the City of Miami. The second phase of the work, assistance in the actual negotiations with Southern Bell, will consist of direct participation by Robert E. Bathen or Fred Saffer, an associate in R. W. Beck and Associates. The cost to the City for this phase of the work is estimated to be on the order of $400 to $450 per person per day including out of pocket expenses plus a small amount of support work in the office of R. W. Beck and Associates for typing, etc. The first meeting with Southern Bell for the purpose of negotiating a new franchise is scheduled to take pla.ce on or about March 12, but no later than March 19, 1976. Rifling and Accounting Data • For services rendered, the Cii .nt shall pay R. W. Beck and Associates, Consulting Engineer, upon submission monthly invoices, an amount equal to the actual hours of services furnished multiplied by the product of the Consult: E..n,,,;:-jeer's established hourly salary cost, inclusive of an allowance for personnel benefits, and a factor of 2.10.
