A RESOLUTION CONFIRMING THE ACTION TAKEN BY
THE CITY MANAGER IN ENTERING INTO A LEASE
AGREEMENT' WITH DADE COUNTY FOR THE LEASING
OF A PORTION OF CITY PROPERTY APPROXIMATELY
AT 1150 N. W. 20 STREET, FOR THE PROPOSED
DADE COUNTY SOLID WASTE TRANSFER STATION;
AND ALSO EXECUTING AND DELIVERING TO DADE
COUNTY A GRANT OF "AIR RIGHTS" EASEMENT TO
A PORTION OF CITY PROPERTY WESTERLY ADJACENT
THERETO,
WHEREAS, by authority of City Resolution No. 75-802,
passed and adopted September 4, 1975, the site for the Metro-
politan Dade County Solid Waste Transfer Station was relocated
to City property situated at approximately 1150 N. W. 20 Street;
and
WHEREAS, it was determined to be in the best interest
of the City that part of this site be leased to the County per
term "perpetual" at a total rental of $1.00, and that the air
rights only above the remaining portion be granted to the County
under a perpetual easement for the construction, use and mainten-
ance by the County of a vehicular ramp necessary for the operation
of said Transfer Station, with the continued use by the City of
the area under said easement and transfer building within the
leased area for City use; and
WHEREAS, said lease and grant of easement are jointly
and severally contingent upon the vacation by the Miami -Dade
Water and Sewer Authority for City use of that area encompassing
and immediately abutting the most easterly situated concrete
water tank (the removal thereof being required) lying southerly
adjacent to said leased premises; and
WHEREAS, said lease and easement shall become null and
void in the event that the premises under lease and easement
ceases to be used as a Solid Waste Transfer Station;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA;

That the action taken by the City
Manager ih entering into a lease agreement with Dade County
for a portion of City property located at approximately 1150
N. W. 20 Street; and also executing and delivering to Dade
County a grant of "air rights" easement for a portion of City
property westerly adjoining thereto, said instruments relating
to the use of the aforesaid property by Dade County for its
proposed Solid Waste Transfer Station be, and is hereby,
confirmed.
