DOCUr►i iEN-rS FOLLOW" WHEREAS, under Florida Law (F.S.255.053) the City is prohibited from making payments in excess of 95% of the contract price to a contractor on a City construction pro- ject until the work is inspected by the architect and the architect has issued a written certificate that the building has been constructed in accordance with the approved plans and specifications and approved change orders and until the City, acting on these recommendations, has accepted the completed project; and WHEREAS, the contract documents for the Miami Modern Police Headquarters Building require the City to retain 10% of the contract amount until final occupancy and authorization of final payment by the City, ; ITEM NO.__. 2_ ---=' t WHEREAS, to implement the moves important o the Police Department and because final acceptance of the project could be many months after the City takes beneficial occupancy, it is requested that the Director of Public Works be given authority to reduce the 10% retainage to 5% retain - age; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF TIME CITY OF MIAMI, FLORIDA; SeCtion 1, The bisector of Public Works, upon first consulting with the Architect and Chief of Police, is hereby authorized to reduce the 10% tetainage to 5% retainage for the Miami Modern Police Headquarters Building before the formal completion and final acceptance of the project by the City Commission, PASSED AND ADOPTED this 27TH day of MAY 1976, MAURICE A, FERRE PREPARED AND APPROVED BY: ((((i7,i ROBERT F. In order to achieve this sc'-iedule the contractor has areed to accolorate complotin of tho essential parts of the building so that there will be a minimum of conflicts with benerIcIal occupancy.
