A RESOLUTION ACCEPTING THE PLAT ENTITLED MIRTA
GARDENS, A SUBDIVISION IN THE CITY OF MIAMI, AND
ACCEPTING THE DEDICATIONS SHOWN ON SAID PLAT AND

WHEREAS, the City Zoning Board and the Department of
Public Works have recommended the acceptance of the plat
entitled MIRTA GARDENS;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The Plat entitled MIRTA GARDENS, being sub-
division of part of the North 1/2, N.W. 1/4, S.E. 1/4, Section
4, Township 54 South, Range 41 East, City of Miami, Dade
County, Florida, which by reference is made a part hereof as
if fully incorporated herein and the dedications as shown
thereon together with all existing and future planting, trees
and shrubbery on said property, to the perpetual use of the
public, be and the same are, hereby accepted and confirmed
by the City of Miami Florida. "DOCUMENT ,INDEX

Section 2. Except for the construction AMA
ments provided for in the Agreement entered into between the
Owner and the Director of the Department of Public Works on
behalf of the City of Miami, Florida, dated April 15, 1976,
the requirements of Chapter 54, Section 54-20, Code of the City
of Miami, Florida as to improvements to be made in subdivisions
will hereby expressly be waived.
Section 3. The City Manager and the City Clerk, both of
the City of Miami, Florida, are hereby authorized and directed
to execute the Plat.

presentation of the plat of MIRTA GARDENS to the City Commission
for acceptance at the nxt available meeting:

In addition to the above, we have attached for your use 22 copies of
a memorandum of general information pertaining to the acceptance of
this plat, and 22 copies of the Engineering Report.
The requested resolution will be one accepting the Plat entitled
M-IRTA GARDENS, a subdivision in the City of Miami, and accepting the
dedications shown on said Plat.
The ori.ginal tracing of the Record Plat will be held in safekeeping
in our office until the resolution accepting the plat has been adopted
by the Commission; after which, the plat will be forwarded to the City
Clerk for execution in the usual manner.
No City funds are involved.
Establiohed procedures require us to distribute several copies of the
re.:olution followini: its adontion by the Commission. Will you please
recuest the City to supply us with four certified copies of the
resolution.

PERTINENT. :INFORMATION
(1) The City Zoning board and the Department of Public Works have
recommended the acceptance of the plat.
ACTION TO BE TAKEN
.(A) The Plat entitled 1]TR`.lA GARDENS being a. subdivision of part of
the North N.U. % , S.E. .,, ection II , Township '34 South, Range
41 Eat, City of Miami, Dade County, Florida, which by reference
is made a part hereof as if Cully incorporated herein and the
dedications as shown thereon together will all existing and
future planting, trees and shrubbery on said property, to the
perpetual use of the public, be and the same are, hereby accepted
and confirmed by the City of Ifiarni, Florida.
(B) Except for tho construction of those improvements provided for
in the Agreement entered into between the Owner and the Director
of the Department of Public Works on behalf of the City of Miarni,
Florida, dated April :15, 1976, the requirements of Chapter 5)1,
Section 51;-20, Code of the City of Miami, Florida as to improve-
ments to be made in subdivisions will hereby expressly be waived.
(C) The City Nanager and the City Clerk, both of the City of Miami,
Florida, are hereby authorized and directed to execute the Plat.

The Proposed Record Plat entitled MIRTA GARDENS is a Tract of
unplatted land having a total area of 1.40171.acres. It is zoned
R-1. This plat is being forwarded to your office for City
Commission action.
The attached detailed report from the Department of Public Works
recommends the approval of ;,he plat by the City Commission of
Miami, Florida, and certifies its correctness as to form.
Also attached are the following itemized papers necessary to
present the Plat to the City Commission of Miami:

A SUBDIVISION IN THE CITY OP I1IAMI, FLORIDA

The accompanying Plat entitled I.IIRTA GARDENS was prepared by
Donald P. Ramsay. It is in correct form for submission to the City
Commission and is forwarded with a recommendation that it be
approved.
• PER T IiiENT INFORMATION REGARDING THE PLAT:
(1) The property platted is a Tract of uriplatted :Land having a
total area of 1.401± acres, It is zoned R-1.
(2) The location of the streets and the widths conform with the
standards of the Department of Public Works of the City of
Miami, Florida.
(3) As certified to by Donald Pe Ramsay, Registered Land Surveyor,
th:i s Plat complies with tits plat filing laws of the State
of Florida.
(1+) By authority of Resolution No. ZB 141-75, adopted April 7, 1975,
the Plat was recommended for acceptance by the City Zoning
Board of Miami.
(5) The attached Certificate of Title Examination dated March 21,
1975, signed by A. A. Thielen, Attorney, indicates that the
fee simple title to the pf•operty platted is correctly vested
in Inter -Continental, Inc., and the Plat has been correctly
executed.
(6) The area platted is not encumbered by mortgages.
(7) In a.ccorda :oe w'l.th the requirements of Chapter 54, Section
514-20, of the Code or The City of Miami, a Cashier's Check
in the amount of $3,800.00 has been tendered by the owner,
Inter -Continental, Inc. This Cashier's Check has been
deposited with the Director of Finance and will guarantee
