HomeMy WebLinkAboutR-76-0457PC/tb 4/30/76 S FOLLOW" RESOLUTION NO, 16.457 A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT WITH THE DEPARTMENT OF TRANSPORTATION (D.0,T,), FOR THE EXTENSION OF BICENTENNIAL PARK WITH THE CONSTRUCTION THEREON OF FACILITIES FOR PARK PURPOSES, 0,718+ ACRES OF D,O,T. PROPERTY LYING ADJACENT TO THE SOUTH LIMITED ACCESS LINE OF INTERSTATE I-395 AT THE WESTERLY APPROACH TO MAC ARTHUR CAUSEWAY. WHEREAS, there is a triangular shaped portion of vacant D.O.T. property having about 200 feet of frontage on Biscayne Bay lying between the South limited access line of Interstate I-395 and the North line of City property, com- prising 0.718+ acres, which the City requires as an exten- sion of its proposed Bicentennial Park; and WHEREAS, on September 13, 1973, the D.O.T. and the City of Miami entered into a highway landscaping joint project agreement whereby the D.O.T. would, at its own cost and expense, beautify, landscape and irrigate the aforesaid proper- ty and the City of Miami would in turn assume the responsibility for the preparation of plans and specifications and mainte- nance upon completion of the project; and WHEREAS, due to its present financial condition, the D.O.T. is unable at this time to fulfill its commitment; and `DOCUMENT INDEX WHEREAS, the City is willing to nacka 2.5 te" and maintain this area and to replace the existing deteriorated bulkhead along the Eastern shore line of Biscayne Bay in order to make this a contiguous part of the Bicentennial Park; and WHEREAS, all of the aforesaid improvements to this portion of D.O.T. property are necessary in order to eliminate the undeveloped eyesore which would otherwise be evident after the City's completion of the Bicentennial Park landscaping Southerly adjacent thereto; and CITY COMMISSION MEETING OF MAY 1 31976 WItAEAS# in being offered a dhoice by the D.O.T. to either purchase on the basis of the appraisal value or to lease` the City elected to lease this land for $1.00 per year for the maximum term offeredt NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized and directed to execute a lease agreement with the D.O.T. for that portion of land to extend the proposed Bicentennial Park, more particularly described as 0.718+ acres of D.O.T. property lying adjacent to the South limited access line of Interstate I-395 at the Westerly approach to Mac Arthur Causeway, Miami, Florida. Section 2. The City Clerk is hereby directed to forward in triplicate the aforesaid agreement to the D.O.T., c/o W. A. Maier, District Right -Of -Way Administrator, 780 S.W. 24 Street, Fort Lauderdale, Florida 33135. PASSED AND ADOPTED this 13 day of MAY 1976. H. D. Director �% De rtment gf` i51dc /T rks 4r DATE April 26, 1976 PiLE Contract B 2677 SuSJEc:r Resolution D.0.1% to City Lease of Belcher Property for Extension of Bicentennial Park REFERENCES: ENCLOSURES There is a portion of unpprOtted Department of Transportation property comprising 0.718f acresng about 200 feet of frontage on Biscayne Bay, lying between the south limited access line of Interstate 1-395 and the north line of City property, which the City of Miami was offered to lease at $1.00 per year for the purpose of extending its proposed Bicentennial Park. Although also offered the choice to purchase this land on the basis of the appraised value, the City elected to lease it even though the maxi- mum term offered was for only 15 years, in addition to the lease being silent as to any renewal options. As an additional expense to the requirement of constructing the improve- ments which will be merged into and become compatible with the abutting proposed Bicentennial Park to the south, the City of Miami is expected to replace the deteriorated bulkhead along the aforesaid D.O.T. property, estimated to be about $200,000. All of the aforesaid improvements to this portion of D.O.T. property are necessary in order to eliminate the undeveloped eyesore which would be- come manifested after the City's completion of the Bicentennial Park landscaping southerly adjacent thereto. Had it not been for the inability of the D.O.T. due to its present financial condition to meet the commitment it made in the highway land- scaping joint project agreement dated September 13, 1973, the City's only expense would be for the cost of the preparation of plans and speci- fications and the maintenance upon completion of the project. THE DEPARTMENT OF PUBLIC WORKS RECOMMENDS ADOPTION OF A RESOLUTION ACCEPTING THE AGREEMENT WHEREBY THE CITY OF MIAMI LEASES FROM THE D.O.T. A PORTION OF LAND FOR. THE EXTENSION OF THE PROPOSED BICENTENNIAL PARK; AND AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND FORWARD SAME TO THE D.O.T. VEG:ACB:jt
