FOR THE CONSTRUCTION OF THE SAN MARCO SANITARY

IN SAN MARCO SANITARY SEWER IMPROVEMENT DIS'
TRICT SR-5316 C (CENTERLINE SEWER) AND REMOV-
ING ALL PENDING LIENS FOR THIS IMPROVEMENT NOT
CERTIFIED HEREBY.
WHEREAS, the Commission of the City of Miami, Florida,
met on the 13th day of May, 1976, pursuant to due legal notice
of said meeting under Section 56 of the City Charter, as amended,
to receive all written objections to the confirmation of the
preliminary assessment roll for the cost of SAN MARCO SANITARY
SEWER IMPROVEMENT SR-5316 C (CENTERLINE SEWER) in SAN MARCO
SANITARY SEWER IMPROVEMENT DISTRICT SR-5316 C (CENTERLINE SEWER),
on the following streets:
On Biscayne and San Marco Islands: North Venetian
Drive, South Venetian Drive, South Venetian Court,
North Venetian Way, South Venetian Way, NE 12
Place, NE 13 Court, NE 13 Place
and
WHEREAS, no objections thereto by any person interested
in, or affected by, said assessments were sustained by the Com-
mission, and said assessment roll appeared, in all respects,
regular and in accordance with the requirements and provisions
of the City Charter, as amended.
NOW, THEREFORE, BE IT RESOLVED BY

Section 1. The prima facie assessments, as a••or-
tioned and indicated on the preliminary assessment roll for
SAN MARCO SANITARY SEWER IMPROVEMENT SR-5316 C (CENTERLINE SEWER)
in SAN MARCO SANITARY SEWER IMPROVEMENT DISTRICT SR-5316 C
(CENTERLINE SEWER), are hereby, in all things, confirmed and
sustained against any and all lots or parcels of ground des-
cribed therein.
Section 2. The sums and amounts assessed against

each of the lots or parcels of ground in said preliminary

assessment roll ate less than the amount that each of the
said lots'` or parcels of ground is especially benefited by
said improvement and that Such amounts are in proportion
to the special benefits that the property received.
Section 3. The total assessable cost of said SAN
MARCO SANITARY SEWER IMPROVEMENT SR-5316 C (CENTERLINE SEWER)
in SAN MARCO SANITARY SEWER IMPROVEMENT DISTRICT SR-5316 C
(CENTERLINE SEWER) in the amount of $128,182.34 is hereby
approved and confirmed.
Section 4. Any pending lien in SAN MARCO SANITARY
SEWER IMPROVEMENT DISTRICT SR-5316 C (CENTERLINE SEWER) for
sanitary sewer improvements not appearing in the preliminary
assessment roll and not certified is hereby cancelled and
removed.

ENCLOSURES:
Construction of SAN MARCO SANITARY SEWER IMPROVEMENT
SR-5316 C (centerline sewer) in SAN MARCO SANITARY
SEWER IMPROVEMENT DISTRICT SR-5316 C (centerline sewer)
has been completed and the Preliminary Assessment Roll
for the Improvement is ready to be presented to the
Commission for confirmation.
The Improvement consisted of laying 10 inch Vitrified Clay
Sanitary Sewer Lines and 6 inch Cast Iron Pipe Laterals to all
lots and parcels as required on Biscayne and San Marco Islands.
The Improvement was necessary to remove the last major source
or pollution in or abutting Biscayne Bay. San Marco Island is .
filled land and is ,an extremely low lying elevation, causing
the septic tanks to be very sluggish in operation, particularly
during flooded conditions. Many lots lying on the Bay side had
overflow lines from the septic tank which discharged sewage
directly into the Bay. Biscayne Island had a combination storm
and sanitary sewer which discharged sewage directly into Biscayne
Bay. As the line was inadequately sized, many of those properties
abutting the Bay had the same system as on San Marco Island;
that is septic tanks with an overflow line to discharge sewage
directly into the I3ay. This overflow, plus the leeching effect
to thc, soil, prompted the State Board of Health, and the Dade
County Health Department to request that the City provide adequate
sanitary sewer facilities to prevent contamination of the Bay.
A public hearing is scheduled for May 13, 1976 to hear objections
to the confirmation of the assessment roll. If no objections are
sustained it will be in order for the Commission to adopt the
resolution confirming the assessment roll.
A section has been included canceling and removing pending liens
placed against properties not benefited by the Improvement.
FF NO OBJECTIONS ARE SUSTAINED THE DEPARTMENT OF PUBLIC WORKS
RECOMMENDS THE ADOPTION OF THE ATTACHED RESOLUTION CONFIRMING THE
PRELIMINARY ASSESSMENT ROLL FOR THE SAN MARCO SANITARY SEWER
DISTRICT SR-5316 C (centerline sewer).
