Hannon City Clerk Ad No. 43909 WNW Weal 12026 I MIAMI HERALD I 5A Judge hands down $3.5 million bond for woman charged in fatal Turnpike chase BY DEVOUR CETUUTE drnonrr@eouniarreld.rom Anna Giza, the woman authorities say is respon- sible for a police chase and cash on Florida's Turnpike that left an in- nocent driver dead, will Likely not be leaving her jail cell soon as a judge set her bond at over 53.5 million Saturday, records show. Giza is facing a slew of charges: felony murder, two counts of aggravated battery on a law enforce- ment officer, aggravated assault on a law enforce- ment officer, aggravated Fleeing causing serious injury or death, grand - theft auto and resisting an officer without violence. A judge signed off on a 53,510,500 bond on her charges, with the murder charge commanding a $1 million bond, her jail re- co rds show. Her court record did not have information Saturday as to who her atromey is or what judge is over- seeing the case. Around 4 p.m. Thurs- day, someone called 911 and reported to Fort Lau - Anna Giza derdale police white Ford F-150 with an orange stripe be- longing to A-1 Orange Exterior Building Service was stolen by Giza, 53. The Coconut Creek Police Department and the Broward Sheriffs Office Deerfield Beach district began searching for the truck. Coconut Creek K-9 Officer Feisthammel ra- dioed that he had spotted the truck going eastbound on Sample Road near Lyons Road. A few minutes later, Coconut Creek officers attempted a traffic stop at Sample Road and the southbound entrance to the turnpike in Pompano Beach. Investigators say Giza didn't get out of the truck. Instead, she threw the truck in reverse and backed into a marked BSO patrol vehicle, striking its front bumper while a dep- uty was sitting inside, the affidavit states. She then drove toward a group of Coconut Creek officers, hitting one of their patrol cars before fleeing southbound onto Florida's Turnpike. Giza raced ahead of authorities, weaving in and out of traffic, driving on the Turnpike shoulder to evade deputies. FHP joined in the pursuit. BSO K-9 Deputy Wen- gert initially attempted a PIT maneuver — or preci- sion immobilir tion tech- nique a controversial police tactic where the officer pushes the rear end sideways of a vehicle be - Mg chased, forcing the vehicle to spin and stop — inthe southbound lanes near the Sunrise Boule- vard exit. He decided not to do it because of concerns about traffic conditions during rush hoar. Almost immediately after, Florida Highway Patrol Trooper Major conducted a PIT maneu- ver. The stolen truck hit the right shoulder wall of the highway and rammed into a black Nissan Altima that had pulled onto the shoul- der. The truck came to a stop. The driver of the Nissan Altima was pronounced dead at the scene. Author- ities did not name the driver who was killed. FROM PAGE IA TURNPIKE Sheriffs Office Deerfield Beach district after the truck was last tracked near Interstate 95 northbound and Southwest 10th Street in Deerfield Beach, the affidavit states. At about 4:28 p.m., BSO Deputy Ruiz placed the truck near Sample Road and Banks Road in Coco- nut Creek, according to the affidavit. Minutes later, Coconut Creek K-9 Officer Feisthammel ra- dioed that he had spotted the truck going eastbound on Sample Road near Lyons Road. A few minutes later, Coconut Creek officers attempted a traffic stop at Sample Road and the southbound entrance to the Turnpike in Pompano Beach. When Ruiz arrived, he saw "multiple marked Coconut Creek police vehicles with their emer- gen y tights activated were stopped around the vehicle and uniformed officers were outside of their vehicles at the front windows of the stolen vehicle giving commands to the driver to exit the vehicle," according to the arrest affidavit. Investigators say Giza refused to get out. Instead, she put the truck in re. verse and backed into a marked BSO patrol vehi- cle, striking its front bum- per while a deputy was sitting inside, the affidavit states. She then drove toward a group of Coconut Creek officers, hitting one of their patrol cars before Fleeing southbound onto Florida's Tumpike. BSO DEPUTIES BEGIN CHASE That set in motion the chase by BSO deputies. "The driver of the vehi- cle was driving in manner that demonstrated a wan- ton disregard for the safe- ty of persons and property by driving at a high rate of speed, weaving in and out of traffic, and driving in the shoulder to evade deputies in marked police units with emergency lights and sirens activa- ted," BSO deputies wrote in Giza's arrest affidavit. At approximately 4:35 p.m., a Broward Sheriffs Office helicopter joined the pursuit, providing updates over the radio, according to the affidavit. Around 4:40 p.m., the stolen truck struck another car about half a mile be- fore the Sunrise Boulevard exit as it continued south - bound on the Turnpike with patrol cars pursuing it, the affidavit states. At about 4:41 p.m., K-9 Deputy Wengert attempt- ed a PIT maneuver — or precision immobilization technique, a controversial police tactic where the officer pushes the rear end sideways of a vehicle be- ing chased, forcing a flee- ing vehicle to spin and stop — in the southbound lanes near the Sunrise Boulevard exit. The driver was taken into custody, according to the affidavit. The driver of the Nissan Altima was pronounced dead at the scene. Author- ities did not name the driver who was killed. In a 2020 investigation, the Washington Post re- ported that at least 30 people had died and hun- dreds were injured from 2016 to 2019 when police used PIT maneuvers to stop pursuits. The affidavit states that Coconut Creek Sgt. Mullin and K-9 Deputy Rogers were jostled when their patrol vehicles were in- tentionally struck during the pursuit Both were taken to hospitals by fire rescue for treatment. Todd B. Hannon City Clerk Ad No. 43911 MUM lifRALD I MDNDAYMAACH I'l FROM PAGE 3A PATA nothing to do with IPata'sj death." Throughout his closing argument, Maroni poked holes in the prosecution's theory. Jones, he said, didn't attend the team meeting because he was suspended and felt embar- rassed. And the arguments between Jones and Pata were not uncommon in "locker room dynamics for a Division I football team." "There was no direct competition between Pate and Rashaun Jones," Ma- roni said, adding that Jones, a defensive back, played a different position from Pate. "Not the type of competition that can drive someone to commit homicide." Moroni then zeroed in on the eyewitness testimo- ny of Conner. The former UM professor, the attomey said, testified that the area was not well lit, and Con- ner wasn't wearing glasses at the time despite having bad vision. Conner also only got a glance at the man who ran off for no more than two seconds. Holding up the photo line-up, Moroni said Jones' photo stands out compared to the other photos be- cause Jones' photo was darker than the others. Conner, the attomey add- ed, could have misidenti- fied Jones from spotting Jones on the sidelines of a game or on the football roster —especially since Conner identified Jones in the line-up seven months after the murder. Maroni, too, focused on how the case was circum- stantial, saying there was no "direct, credible evi- dence" tying )ones to Pata's murder. Instead, prosecutors made "several leaps" to try to link the fatal bullet to Jones, Maio- ni said. A firearms expert couldn't testify than the bullet retrieved from Pa- ta's head was .38 caliber, Maroni said, as the bullet broke within Pata's skull. But prosecutors, he added, still alleged that a .38 re- volver Jones owned was the murder weapon, de- spite conflicting testimony about whether Jones owned a gun. Moroni also highlighted how possible suspects were quickly ruled our, includ- ing a man whose finger- prints were found on the hood of Pata's car. Urging the jury to find Jones not guilty, Maroni told jurors they had to feel confident to render a guilty verdict — to the point they are comfortable when thew heads hit the pillow at night. "(Prosecutors( have not met their burden because they cannot meet their burden," Moroni said. FROM PAGE ZA CUBA poke holes in the state's narrative, insisting the Cuban government is not credible. "The original story was that they were transport- ing, it was human smug- gling and now they're terrorists," he told Fox News. "So again, they're changing their story. We need to get to the bottom of it" Notably, Miami's third Cuban American in Con- gress, Mario Diaz-Balart — who holds the highest leadership positions in House committees and has held federal office the longest — remained silent on the matter all week, much like the rest of Trump world. Diaz-Ba- lart's office declined an interview with the Herald but confirmed he had not made any public state- ments about it. The disparate responses of the South Florida dele- gation, who've sought to be the voice of the Cuban diaspora in Congress, point to the tense stakes of the timing of the shoot- out For Florida's Cuban - American politicians, "There is some awkward- ness about this moment," Bustamante, the Uni- versity of Miami historian said. "This is a moment in which the United States seems to be having back - channel dialogues with some folks in the Cuban government, that's some- thing that the South Flor- ida delegation has gener- ally opposed," he said. "They are, t think, trying to figure out how to navi- gate that without creating an obvious break with the administration." 'A PATRIOT NOT A TERRORIST The family, friends and social media accounts of the 10 men named by the Cuban government have provided some of the few public details about what may have motivated their journey to Cuba. Pavel Ailing Pena, iden- tified by the Cuban gov- ernment as one of the men killed in the shoot- ing, posted at -times fan- tastical Al videos on his Facebook page of heavily - armed soldiers shooting police officers and arrest- ing the island's leader, Miguel Diaz-Canel Two other men, Mi- chael Ortega Casanova and Leo Enrique Cruz Gomez, were active mem- bers of Casa Cuba de Tampa, anticommu- nist Cuban group, accord- ing to vice president Rene Montes de Oca. "Both were always very firm in their convictions and believed that to bring down the Cuban govem- ment you had to fight with weapons," Montes de Oca said. "Personally, I was one of those who warned them many times that it was dangerous and could be a suicide mission." Another man Cuba said it detained, Corrado Ga- lindo Sariol, recently shared a video on Face - book of a man dressed in camo and armed with a rifle criticizing Cuban communists for destroy- ing their country, threat- ening action against Diaz- Canel's government and encouraging other Cubans to prepare. Hannon City Clerk WWI HERALD I Maac.O HAarl2 run Pentagon announces first 3 U.S. deaths in war with Iran BY rE COOPER NTT Arm sweep WAsum.mON Three U.S. service members have been killed in action and five have been seriously wounded, the Pentagon said in an- nouncing the first U.S. troops to die in President Donald Trump's war with Iran. US. Central Command did not say where the troops were killed. Two military officials said that an Army base having U.S. troops in Kuwait was one of the many U.S. bases in the region that had been hit in retaliatory Iranian strikes. Several other troops sustained minor shrapnel injuries and concussions and are in the process of being returned to duty," Central Command said in dSocial media post Sun- ay.media While Central Com- mand did not confirm the location of the troops killed and injured, the involvement of shrapnel could imply that the in- juries were the result of an Iranian strike. Since the joint U.S. and Israel military strikes began Saturday morning, Iran has launched hun- dreds of retaliatory mis- siles at a wide range of U.S. and Israeli targets in the region, as well as at Arab countries it considers allies of the United States. In the past, Iran has given waming before launching retaliatory strikes on bases housing U.S. troops. In announcing the start of the war in Iran early Saturday erring, Trump said that the campaign could result in American deaths. Gen. Dan Caine, the chair of the Joint Chiefs of Staff, had cau- tioned Trump in recent private meetings that U.S. troops could be killed or injured. The Pentagon had moved some troops in the region to different loca- tions in advance of Sat- urday's attacks. "My administration has taken every possible step to minimise the risk to U.S. personnel in the re- gion," Trump said Sat- urday. FROM PAGE 6A MIDTERMS that Republicans should nationalize them (again, aides walked it back be- fore the president doubled down on the notion of the federal government get- ting "involved"). On social media and in public remarks, Trump has indulged, with increasing frequency, debunked theories about how the 2020 election was stolen. Now those words are sometimes accompanied by govemment action. His warning in January that there would be new prosecutions stemming from the 2020 election was followed, days later, by the FBI's search (or nearly 6-year-old ballots in a Democratic strong- hold in Georgia. The president has pushed Republicans in Congress to pass restric- tive new voting laws, and warned of more executive orders to impose them himself, even as courts have ruled against some of his past efforts. At the direction of the White House, homeland security officials are intensifying efforts to investigate vot- ing by noncitizens. Control of Congress hangs in the balance this fall, and Tnunp has warned that he will be impeached for a third time if Democrats regain con- trol of the House. The White House is pushing every lever to hold power, especially in the House. Last year, that included Trump's unusual drive for Republican- controned states to redraw congressional maps to squeeze out more GOP seats — setting off an on- going nationwide redis- tricting war. Trump's team is also preparing a more tradi- tional campaign: raveling, raising money and trying to address affordability. But the active under- mining of faith in the election's outcome is play- ing out in parallel — and the specter of a forceful federal intervention hangs over November. "The federal govern- ment should get in- volved," Trump said in the Oval Office in February when asked about Ms suggestion that Repub- licans should nationalize elections. Naming three Democratic -dominated cities, he added, "If they can't count the votes legal- ly and honestly, then somebody else should take He was surrounded by congressional Republicans as he spoke, including Speaker Mike Johnson, who stood just behind Trump's left shoulder, his fingers fidgeting as they gripped a red Trump hat. "If a state can't run an election," Trump said, "I think the people behind me should do something about it." DEMOCRATIC FEARS Democrats are sounding alarms as they war -game for extreme subversion soThey wam that the Trump administration could deploy federal agents to target polling places and distort turnout, that the Justice Depart- ment could misuse private voter roll data, or that the government might seize voting machines. And they worry that congressional Republicans could refuse to seat Democratic win- ners (the Constitution gives Congress notable leeway to seat new mem- bers). "We will have to pre- pare in ways that differ from prior cycles for the possibility that Trump and Republicans will try any- thing and everything to H. Hakeem Jeffries, D-N.Y., the mi- nority leader, said in a recent interview - Jeffries said he had been heartened that the Su- preme Court ruled that Trump did not have un- fettered ability to deploy National Guard troops, calling that "the biggest tool that an authoritarian - type leader would have." In 2020, Trump had considered using the Na- tional Guard to seize vot- ing machines. Looking back, he told The New York Times in January, "Well, I should have." Behind the scenes, Democratic state attor- neys general have been preparing for dire poten- tial scenarios and drafting legal documents to head off federal intrusion, such as removing armed forces from polling locations. Even moderate Demo- crats are expressing deep Sen. Catherine Cortez Masco of Nevada warned in a ant interview with the Times that federal immigration agents could be deployed differently. "The concern," she said, "is that next is they're going to bring them out around our election pro - as. They're going to try to claim the election is being stolen." Abigail Jackson, a White House spokesperson, dis- missed Democratic con- cerns and said Trump was "committed to ensuring that Americans have full cadence in the adminis- merion of elections." "No one should take this Democrat pearl -clutching seriously when they have spent years undermining and denying the results of free and fair elections — including the election of President Trump," she said, adding that Trump was simply committed to "to- tally accurate and up-to- date voter rolls free of errors and unlawfully regis- tered nondhzen voters." ELECTION -SKEPTICAL TRUMP ALLIES Whatever guardrails existed around Trump during his first tens ap- pear frayed or absent. He is now largely surrounded by pliant advisers and party officials. It turned out that it was a Trump appointee, Kurt Olsen, who had set off the recent Georgia investiga- tion that resulted in the FBI raid in Fulton County, according to a recendy unsealed search warrant. And Trump's director of national intelligence, Tulsi Gabbard, was unexpected- ly at the scene. She con- nected him on the call with the agents. Steve Simon, the Demo- cratic secretary of state in Minnesota, called the federal actions "largely sloppy, unreliable, even menacing.* The Trump administration recently and explicitly linked a demand for sensitive voter information in the state with the restoration of law and order. "I never thought in the year 2026, 1 would be saying that the federal government is an impedi- eent right now to smooth lections, and nit an any," Simon said. Some right-wing activ- ists who fanned the con- spiratorial dames of fraud in 2020 are no longer outside agitators. instead, they occupy powerful seats inside the federal government. They include FBI Direc- tor Kash Patel, who was a prominent promoter of the conspiracy theory that the riot at the Capitol on Jan. 6, 2021, was planned and instigated by the FBI; Attorney General Pam Bondi, who traveled in 2020 to Pennsylvania, where she claimed to have evidence of cheating" that never fully material- ized in taut; and Harmeet Dhillon, who was a leader of a Trump lawyers coali- tion in 2020 and is now the assistant attorney general for civil rights. Olsen went from ad- vising Trump privately in the ram -up to Jan. 6 to being named Trump's director of "election secu- rity and integrity." Others are burrowed deeper in the bureaucracy. On Capitol Hill, Trump's congressional allies are planning a series of votes on legislation to impose stricter voting requirements. The mea- sures e not expected to become law, but they amplify the false accusa- tions about widespread fraud. Democrats have little faith in Johnson to stand up to Trump. In 2020, Johnson, then a low -pro- file lawmaker from Loui- siana, played a pivotal role in justifying Trump's false claims of widespread fraud. InFebruary, Johnson was talking conspiratorial- ly in the Capitol about California's standard but unusually long process of postelection ballot count- ing. The leads of Repub- lican candidates, he claimed, had "just mag- ically whittled away." "It looks on its face to be fraudulent," Johnson said. "Can 1 prove that? No." Demons hope the courts can prevent some overreach by the Trump adminislration. A sweeping executive order by Trump n election odes last year has largely been blocked by federal judges, including one in January who ex- plained his reasoning sic dnctly. "The Constitution," he wrote, "assigns no author- ity to the president over federal election adminis- tration." FROM PAGE 6A BATHROOMS female bathrooms and locker rooms in keeping with her gender identity. Management rejected the request, citing the presi- dent's executive order, and the complainant ap- pealed. While the EEOC's pri- mary role is to enforce federal civil rights laws in the private -sector work- place, it has some author- ity over complaints and appeals concerning the federal government. Still, Thursday's deci- sion was ambitious. Nei- ther Tide VII nor the Su- preme Court has defined "sex," and the EEOC does not have authority to in- terpret the law.
