A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO ISSUE A PERMIT AND TO GRANT AN EASEMENT TO THE CITY OF MIAMI BEACH IN ORDER FOR SAID CITY TO INSTALL AND MAINTAIN A 54" FORCE MAIN ON CITY OF MIAMI PROPERTY LOCATED AT VIRGINIA KEY FOR THE PURPOSE OF CONVEYING SEWAGE FROM THE CITY OF MIAMI BEACH "SUPPORTIVE TO THAT EIVIRGDNDA WATER AND SEWAGE TREATMENT PLANT DOCUMENTS FOLLOW" WHEREAS, the City Commission adopted Resolution No. 42-695 on July 22, 1971 approving the allocation of additional City -owned land to the City of Miami Department of Water & Sewers for the purpose of allowing the modernization of the sewage treatment plant located on Virginia Key; and „DOCUMENT INDEX ITEM N0. zitWHEREAS, the City of Miami Water & Sewer Board approved the terms and conditions of a joint contractual agreement between the City of Miami Department of Water & Sewers and the City of Miami Beach, at its regular meeting on August 12, 1971, whereby the proposed modernized sewage treatment plant's increased treatment capacity of 55 million gallons a day would be utilized by the following ratio: 30 million gallons a day allocated to the City of Miami Beach and 25 million gallons a day allocated to the Department of Water & Sewers of the City of Miami, and whereby the City of Miami Beach agreed to pay over one-half of the cost of increasing said plant capacity; and WHEREAS, the construction of the modernized sewage treatment plant on Virginia Key is nearing completion; and WHEREAS, it is now necessary to grant a permit and an easement to the City of Miami Beach for the purpose CITY COMMJSSON MEETING OF APR2 21976 RES?LUTIQN RLMAKa .,,.,.....,,,.,,,,f,•z,...-• of allowing it to construct its sewage force main from the City of Miami Beach to the Virginia Key sewage treatment facility; and WHEREAS, the expanded facilities at Virginia Key will better and more efficiently serve the Central District of Dade County, which includes the City of Miami; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized and directed to issue a permit and to grant an easement to the City of Miami Beach in order for said city to install and maintain a 54" force main on the City of Miami property located at Virginia Key for the purpose of conveying sewage from the City of Miami Beach to the Miami -Dade Water and sewage treatment plant at Virginia Key. LLOYD Cit Attorney STAVE OF FLORIDA) ) COUNTY OF DADE ) THIS GRANT OF CASEMENT made this day of A.D. 1976, by and between THE CITY OF MIAMI, A MUNICIPAL CORPORATION OF THE STATE OF FLORIDA, as the party of the first part, and THE CITY OF MIAMI BEACH, A MUNICIPAL CORPORATION OF THE STATE OF FLORIDA, the patty of the second part, WITNESSET'H: That the party of the first part, for and in consideration of the sum of One Dollar and other valuable considerations paid by the party of the second part, receipt of which is hereby acknowledged, hereby grants unto the party of the second part a permanent easement, license and privilege to enter upon, and to perform any acts required for the construction, installation and maintenance of a sewage transmission main upon the following described land in the County of Dade and State of Florida, to -wit: I (See Attached Description and Drawing also Attached hereto and made a part hereof) The party of the first part reserves the right to enter upon and/or to construct any facility over, and across, the aforesaid easement, not inconsistent however, with the right of the use and maintenance of the said transmission main by the party of the second part. The party of the second part agrees to construct at its own cost and expense the necessary sheathings and other required safeguards for the protection of its proposed transmission main whenever the party of the first part elects to construct any facility over, and across, the said easement, or over or under the proposed transmission main. The party of the second part shall first submit to the party of the first part for approval any and all construction plans prior to the awarding of its construction contracts, and shall obtain the necessary permits therefor, from the party of the first part. Should the above easement be abandoned or discontinued by law or otherwise, or should the party of the secqnd part breach any of the aforesaid conditions, the said easement shall cease and revert to the party of the first part, or its successors or assigns. IN WITNESS WHEREOF, THE CITY OF MIAMI, A MUNICIPAL CORPORATION OF THE STATE OF FLORIDA, has caused this instrument to be executed in its name and its corporate seal affixed by its CITY MANAGER and its CITY CLERK, both thereunto duly authorized, this day of A.D. 1976. DOCUP,IENTS FC LL I Commence at a point on the west line of Section 9, Township 54 South, Range 42 East, 147.5 feet north from the S.W. corner of said Section 9; thence run east along a line 147e5 feet north of and parallel with the south line of said Section 9 for a distance of 3,450.00 feet to the "Point of Beginning" of the center line of a 25.00 foot easement for a force main lying 12.5 feet either side of the following described line; thence continue east along a line 147.5 feet north of and parallel with the south line of said Section 9 for a distance of 425.00 feet to a point; thence deflecting 72° 30' 00" to the left from the extension east of the last described course run northeastwardly to an intersection with the City Limits Line of the City of Miami.
