WHEREAS, the Local. Government Cofiprehensive Planning Act of 1975, Chapter 75.257 LaWs of Florida, requires that local governments, throughout Florida designate by ordinance_a local planning agency on or' before July 1, 1976, Which:local planning agency shall prepare a comprehensive plan after hearings to be held after due public notice and shall:make recommendations to the local governing body regarding the adoption of such plan, or element or portion thereof; and WHEREAS, City Charter Section 72 and Ordinance No. 8234 dated February 28,1974 have provided for the creation, of"the Planning Advisory Board of the City of Miami,' which Planning Advisory Board is to serve' as an instrument of advice and recommendations in all phases and aspects of'the comprehensive planning program including the review and subsequent recommendations to the City Commission for. • adoption of comprehensive and coordinated general plans or portion or portions thereof after due public notice and public'hearing or hearings; and. WHEREAS, the functions, powers and duties of the Planning Advisory Board of the City of Miami as defined. in Section 72 of the City Charter are wholly consistent with the responsibilities, powers and duties of the local planning agency described in Chapter 75-257 Laws of Florida; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,.FLORIDA; Section 1s The Planning MdVisOry'Mard of the City of Miami be and the same is heteby designated, as the local planning agency as described in Chapter 75 257 Florida Statiitea. Section 2. The responsibilities, powers and duties of the local planning agency (Planning Advisory board) shall be as those set forth in Section 72 of the City of Miami Charter, Ordinance No, 8234 passed and adopted on February 28, 1974 and Chapter 75=257 of the LaWs of Florida. Section 3. Official copies of this Ordinance shall be transmitted by the City Clerk to the Division of State Planning, Department of Administration, 660 Apalachee Parkway, Tallahassee, Florida 32304, and the South Florida Regional Planning Council, 1515 N.W. 167th Street, Miami, Florida 33169. Section 4. All laws or parts of laws in conflict herewith be, and the same are hereby repealed insofar as they are in conflict. Section 5. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole.
