68710 THE COMPREHENSIVE ZONING ORDINANCE FOR
THE CITY OF MIAMI, tlY ADDING 2:UNNUMBERED PARAGRAPH5 TO
SUBSECTION (2) OF SECTION 17, ARTICLE IV ENTITLED FENCES,
WALLS AND HEDGES, TO PROVIDE FOR A REQUIREMENT
OF A 6 FOOT MALL BETWEEN NONRESIDENTIAL AND
RESIDENTIAL PROPERTY; AND TO LIMIT THE USE OF_ DANGEROUS
MATERIALS INCORPORATED IN FENCES AND WALLS; REPEALING
ALL ORDINANCES, Cob SECTIONS OR PARTS THEREOF IN CON-
FLICT INSOFAR AS THEY ARE IN CONFLICT; AND CONTAINING A
SEVERABILITY PROVISION.
WHEREAS, the Miami Planning Advisory Board at its
meeting of December 2,.1975, Item No. 1, following an advertised
hearing, adopted Resolution No. PAB 61-75 by a 5 to 0 vote
(3 members absent) recommending an amendment to the Comprehensive,
Zoning Ordinance No. 6871, as hereinafter set forth; and
WHEREAS, the Commission finds that an genuine emergency
exists for the passage of this Ordinance; and
WHEREAS, the Commission deems it advisable and in the
best, interest of the City of Miami and its inhabitants to amend
said Ordinance as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. The, City of Miami Comprehensive Zoning
Ordinance No. 6871, be and the same is hereby amended by adding
2 unnumbered paragraphs to Subsection (2) of Section 17, Article..
IV, entitled FENCES, WALLS AND HEDGES to read as follows:.
Wherever non-residential land use activities
are developed adjacent to residential uses, a
fence or wall shall be provided adjacent to such
properties. Such wall or, fenceshall be at least ,
six (6) feet, in height andnot more than eight
(8) feet in height,
The use ofbroken glass, spikes,rusty nails or..other
'
similar materials shall be prohibited, in all zoning
districts, Materials such as barbed wire
fencing located along the topof a fence or.,
wallmaybe permitted (by the Building Department)
in accord with appropriate installation standards
when its placement is essential to the safety,
welfare, and securityof the property and/or its
inhabitants,

herewith be, and the safe are hereby repealed ifisofar as they
are in conflidt.
Seotioh 3. Should any aft oY provision of this
ordinance be declared by a court'of competent jurisdiction to be
invelidt the same shall not affect the validity of the ordinance
as a whole.
Section 4. The requirement of reading this Ordinance
on two separate days is hereby dispensed with by a vote of not
less than four -fifths of the Members of the Commission.
Section 5. The provisions of this Ordinance shall
become effective immediately upon passage.

The City Commission recently adopted an Ordinance
revising the Comprehensive Zoning Ordinance No.
6871, Article IV, Section 17. In the preparation
of the Ordinance two paragraphs which were recommended
by the Planning Advisory Board were inadvertently
omitted. Therefore, a new Ordinance has been prepared
to include this recommendation.
