2. SpECIRL COMMISSION MEETING MOTION CF INTENT REGARDIIG 2NCLUSION

Mr. Plummer: Mr. Mayor I make a motion at this time that the administration
and the University of Miami together with the architects and any other interested
parties that need to finalize some type of negotiations be presented to this
committion be done as quickly as posaibla with a date no Iater than May 27,
for final approval of this commission, and at such time a public hearing also
be included so that final determination by this commission can de had.
Mayor Ferre: That will not do tale job .
Mr. Andrews: We have a schedule which we are trying to integrate a
contract requirement with, and a development of a master plan and that would
take place about June 7 or so. It is close. to the date you are suggesting,
but it follows the contract requirement and I suggest we adhere to this schedule.
Mayor Ferre: May I make a comment to the commission on this. I think I
see where the compromise area is and what could be 8~confuaing thiag. I under-
stand Father Gibson's paint, and I understand Rose's point which I didn't at
first, --I agree that it is not a legally binding but certainly if it is ever
challenged in court, the fact that we called for a public hearing is certain
in our favor before any court. And it makes s lot of common sense.
What~I was concerned about, and then I saw the light, is, we have already
been stalled on this with all due respects, and I am not accusing anybody but
we have been playing around with this foz 6 months. What I don't want to do
is to see another 6 months go by and be back at this point without any architect-
ural drawings or moving ahead. What I would like to recommend is that one, we
go ahead an make a statement of general intent, two, that we tell the city
manager to proceed with the University to establish organizational framework
and design, three, that we proceed to determine the legal process, four, that
we start to negotiate an agreement, five, that we start the program, the
master plan, etc. etc., and that when tl.ia is accomplished that it be brought
back to the comrnisaion far final ramification, at a public hearing,
Mrs. Gordon: I move that.
Mr. Plummer: exactly what I said.

A MOTION OF GENERAL TNTEIv'T THAT THE INCLUSION OF THE UNIVERSITY
OF MIAMI'S 'TAMES L KNIGHT CONVERENCE CENTER AT THE CITY OI MIAMI'S
• CONVENTION CENTER SITE IS TO THE MUTUAL BENEFIT OF BOTH PARTIES;
DIRECTING THE CITY MANAGER TO PROCEED IMMEDIATELY TO CONFER WITH
THE UNIVERSITY TO ESTABLISH THE ORGANIZATIONAL F'RAMEWORI~ FOR THE
DESIGN, DEVELOPMENT, CONSTRUCTION, PROGRAMMING AND OPERATION OF THE
COMBINED FACILITIES; DIRECTING THE CITY ATTORNEY TO DETERMINE THE
LEGAL PROCESS AND PROCEDURES BY WHICH PUBLIC AND PRIVATE FUNDS CAN BE
USED TO DEVELOP THIS FACILITY; DIRECTING THE CITY MANAGER TO NEGOTIATE
AP# AGREEMENT WITH THE UNIVERSITY OF MIAMI THAT WILL DEFINE AND DELINEATE
THE LEGAL OBLIGATIONS AND FISCAL RESPONSIBILITIES OF BOTH PARTIES:
FURTHER DIRECTING THE CITY MANAGER TO INSTRUCT THE ARCHITECT/ENGINEER
AND 21IS CONSULTANTS TO DEVELOP AN ARCHITECTURAL PROGRAM AND MASTER
PLAN OF THE COMBrNE FACILITIES THAT IS PHYSICALLY AND PROGRAMATICALLY
COMPATIBLE TO BOTH PARTIES; AND TO SUBMIT THE FINAL RESULTS TO THE
COMMISSION AT A PUBLIC HEARING TO BE HELD JUNE 10, 1976
Upon being seconded by Commissioner Gibson, the motion was passed
and adopted by the following vote:
AYES: Commissioner Manolo Reboao

Commissioner J. L. Plummer, Jr.
Vice-Mayor Rose Gordon
Mayor Maurice A. Ferre
NOES: None.
Mayor Ferre: I think it is important that as we proceed, now that the
vote is over, both Dr. Stanford and MR. Andrews, that as we proceed, that
this commission be informed. I. think it is unfortunate for ua, to be informed
the day we are voting on something. I am not accusing anybody, but we have a
fulltime man on this. He is a capable man, and had much experience and I think
that on a bi-weekly basis, that this commission should be fully informed as to
where you are, as to what the University wants and what you are agreeing on,
so we don't have surprises at the end of this process.
Rev. Gibson: Mr. Mayor I want to add this, I was a little disturbed
with Dr. Stanford, this i.s the first time he had seen this.. That bothers me.
Isn't that what you said when you made your presentation?
Dr. Stanford: Yes.
REv. Gibson: What I am s~iying is, 7 wasn't distressed, but I also want to
add, I am a slow learner,----
Mr. Andrews: Just for the record Father, perhaps Dr. Stanford is not
aware of this, but this was developed in concert with his staff. His staff
member was not able to be here this morning, and we decided it was important
enough that someone from the University be here and Dr. Stanford volunteered
to come here rn be part of this, so he has seen this for the Brat time, but it
was worked out with his staff.
Dr, Stanford; I should have said that, that Dr. Robert Allen, the Dean
of continuing studies is in Washington today, and T believe he did meet with
Mr, Andrews and others and was worked out. I didn't mean to imply I was off ended
at seeing it for the first time this morning,
