A SEVERABILIT' PROVISION.
WHEREAS, the Miami Planning Advisory Board, at its
meeting of February 18, 1976, Item No. 2, following an advertised
hearing, adopted Resolution No. PAB 5-76 by a 7 to 0 vote
as hereinafter set forth; and
WHEREAS, the City Commission deems it advisable and
in the best interest of the inhabitants of the City of Miami to
amend the City of Miami Comprehensive Zoning Ordinance as
hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, the Comprehensive
Zoning Ordinance for the City of Miami, Article VII, Low Density
Multiple R-3 District be and the same is hereby amended to
allow exceptions to the height limit as a conditional use by,
adding a new paragraph () to subsection (6-B), Section (1) to
read as follows:
(c) Buildings, structures, or parts thereof
may be erected to heights exceeding the
height set forth in Section:4 of this.
Article provided that:
1. The height being requested is
spacially congruent with the
character and height of development
in the surrounding area.
2. Development is in accord with community
and neighborhood objectives.

Section 4,- Height
Except as May be permitted puteuant 'to Paragraph (C) ,
Subsection (6"E) , Section 1 of this, Article/ nb.

parking is provided under the building, in which
case theheight shall not exceed thirty 00) feet.
Section 3. All ordinances, code sections, or parts
12 thereof in conflict herewith, insofar as they are in conflict,
are hereby repealed.
14 Section 4. Should any part or. provision of this
15 ordinance be declared by a court of competent jurisdiction to
16 be invalid, the same shall not affect the validity of the
ordinance as a whole.

Gentlemen:
The Miami Planning Advisory Board, at its meeting of February 18, 1976,
Item.42, following an advertised Hearing, adopted Resolution No.
PAB 5-76 by a 7 to 0 vote Recommending an amendment to The Comprehensive
Zoning Ordinance 6871 by revising, ARTICLE VII, LOW DENSITY MULTIPLE,
R-3 District, Sections l and 4. to allow exceptions to the height limit
as a Conditional Use by adding a new paragraph (b). to sub -section
(6-b); Section (1), and deleting Section 4 in its entirety and in lieu
thereof substitute a new Section 4 as shown on Page 7 of the attached
Minutes.
